A. considérant que la Direction nationale anticorruption de la Roumanie a demandé la levée de l'immunité d'Adrian Severin, député au Parlement européen, afin de permettre au Bureau du Procureur roumain de mener l'enquête sur l'affaire et d'engager des poursuites contre Adrian Severin, de requérir la perquisition du domicile ou des bureaux de l'intéressé, ainsi que de réaliser des contrôles informatiques ou toute autre recherche électronique qui s'avérerait nécessaire, d'engager une procédure pénale contre l'intéressé pour corruption passive et/ou trafic d'influence, ou pour tout autre motif juridique pouvant correspondre à l'infraction ou aux infractions présumée(s), devant les juridictions répressives compétentes,
A. whereas Romania's National Anti-Corruption Department has requested the waiver of immunity of Adrian Severin, Member of the European Parliament, in order to enable the Romanian Prosecutor's Office to conduct the necessary investigations and to take legal action against Adrian Severin, to call for a search of his house or offices and to carry out computer checks or any other electronic searches which might be necessary, to initiate criminal proceedings against Mr Severin on the grounds of passive corruption and/or influence peddling or any other legal description that might be given to the alleged offence(s) before the criminal courts having jurisdiction,

B. considérant que la levée de l'immunité d'Adrian Severin porte sur des infractions présumées de corruption au sens de l'article 6 de la loi roumaine n° 78/2000, en liaison avec l'article 254 (corruption) et l'article 257 (trafic d'influence) du Code pénal, ainsi qu'avec l'article 8 , point b, de la loi n° 78/2000,
B. whereas the waiver of the immunity of Adrian Severin concerns alleged corruption offences covered by Article 6 of Romanian Law No 78/2000 in conjunction with Article 254 (corruption) and Article 257 (influence peddling) of the Criminal Code and with Article 8 (b) of Law No 78/2000,

– ayant entendu Adrian Severin le 23 mai 2011, conformément à l'article 7, paragraphe 3, de son règlement,
– having heard Adrian Severin on 23 May 2011 in accordance with Rule 7(3) of its Rules of Procedure,

– vu la demande de levée de l'immunité d'Adrian Severin, transmise le 5 avril 2011 par la Direction nationale anticorruption (Bureau du Procureur près la Haute Cour de cassation et de justice de Roumanie) et communiquée en séance plénière le 6 avril 2011,
– having regard to the request for waiver of the immunity of Adrian Severin, forwarded by the National Anti-Corruption Department (Prosecutor's Office of the High Court of Cassation and Justice of Romania) on 5 April 2011 and announced in plenary sitting on 6 April 2011,

1. décide de lever l'immunité d'Adrian Severin, à l'exclusion des restrictions à sa liberté personnelle;
