The Commission considered on a preliminary basis that the aid should be recovered and that the legitimate expectations recognised in the First and Second Decision cannot be extended (retroactively) to situations (indirect acquisitions) which were, following the consistent administrative practice by the Spanish authorities, not covered by the scope of application of the contested measure at the time of the First and Second Decision.

Notes, however, that the level of committed appropriations carried over to 2013 was high for title II (administrative expenditure) at 35 % and title III (operating expenditure) at 46 %; acknowledges that for title II, this was caused, to a large extent, by events beyond the Agency’s control, such as the late invoicing of the 2012 office rental costs by the Spanish authorities; notes, moreover, that in order to meet the increased operational needs it was faced with in the last quarter of 2012, the Agency ordered a high volume of goods and services for which delivery was still pending by the end of the year; acknowledges that for title III, an important reason for the high level of carry-overs was the considerable workload faced by the agency as a result of the large number of IT projects that were either launched or ongoing in 2012 and this workload had an impact on the timeliness of procurement procedures in the case of two IT projects launched in 2012; acknowledges, furthermore, that expenses related to training and missions undertaken by staff and experts in the last quarter of 2012 were only due for reimbursement at the beginning of 2013;

Toutefois, même si le gouvernement espagnol n'avait pas pu imposer ou suggérer la nécessité de considérer les synergies transrégionales comme condition d'octroi des fonds, les régions auraient pu prendre en compte cette possibilité afin de s'assurer qu'elles optaient pour la solution la plus avantageuse pour leurs administrés.
However, even if the Spanish government had not been able to impose or suggest the need to take into account cross-regional synergies as a condition for the granting of the funds, the regions could have taken this possibility into account in order to ensure that they were choosing the most cost-efficient solution for their taxpayers.
