IN-CONTEXT TRANSLATIONS

L’article 5, point 3, du règlement no 44/2001 doit être interprété en ce sens que, lorsque des défendeurs établis dans différents États membres se voient réclamer en justice des dommages et intérêts en raison d’une infraction unique et continue à laquelle ils ont participé dans plusieurs États membres à des dates et à des endroits différents, cette infraction à l’article 101 TFUE et à l’article 53 de l’accord sur l’Espace économique européen, du 2 mai 1992, ayant été constatée par la Commission européenne, le fait dommageable s’est produit à l’égard de chaque prétendue victime prise individuellement, chacune d’entre elles pouvant, en vertu dudit article 5, point 3, choisir d’introduire son action soit devant la juridiction du lieu où l’entente concernée a été définitivement conclue ou, le cas échéant, du lieu où un arrangement spécifique et identifiable comme étant à lui seul l’événement causal du dommage allégué a été pris, soit devant la juridiction du lieu de son propre siège social.
