X. considérant que la pratique des rescrits est devenue, dans le contexte de relations plus étroites et plus coopératives entre les administrations fiscales et les contribuables, un moyen de faire face à la complexité croissante du traitement fiscal de certaines opérations dans une environnement économique de plus en plus complexe, mondialisé et numérisé; que, même si les États membres affirment que les rescrits ne constituent pas des accords discrétionnaires, mais simplement un outil permettant de clarifier la législation fiscale en vigueur, tout en les gardant secrets – les travaux de la commission spéciale du Parlement ont confirmé que les rescrits fiscaux peuvent être appliqués hors du cadre légal, sous la forme d'accords informels ou discrétionnaires, qui justifient des montages fiscaux fondés sur des mécanismes de planification fiscale dont les multinationales font grand usage dans le but de réduire leur contribution fiscale; que cela semble particulièrement (mais pas exclusivement) poser problème avec les rescrits relatifs aux prix de transfert entre des entreprises d'un même groupe (c'est-à-dire les accords préalables sur les prix); qu'en procurant une sécurité juridique à certains contribuables seulement, ils risquent de créer des inégalités entre les entreprises auxquelles ils bénéficient et les entreprises du même secteur qui n'y ont pas droit;
X. whereas the practice of rulings developed, in the framework of a closer and more cooperative relationship between tax administrations and taxpayers, as a tool to tackle the increasing complexity of the tax treatment of certain transactions in an increasingly complex, global and digitalised economy; whereas – despite Member States’ asserting that rulings are not discretionary, but merely a tool to clarify existing tax legislation, while keeping them secret – its special committee’s work has confirmed that tax rulings can be issued without any legal framework through informal or discretionary arrangements, that support tax-driven structures which rely on tax planning tools typically used by MNCs to reduce their tax contribution; whereas this seems to be an issue particularly – although not exclusively – with rulings related to pricing of intra-company transfers (so-called Advance Pricing Agreements); whereas, in providing legal certainty only to some selected actors, they might create inequality between companies to which they have been granted and companies in the same sector which have no access to them;

Avant l'entrée en vigueur du traité de Lisbonne, le Parlement était simplement consulté par le Conseil sur la conclusion de ce type d'accords. Les avis ainsi rendus étaient dépourvus d'assise institutionnelle, ce bien qu'en vertu de l'accord-cadre actuel sur les relations entre le Parlement européen et la Commission, la Commission soit tenue de fournir des informations à tous les stades de la procédure menant à la conclusion de ces accords, celles-ci devant être transmises au Parlement dans des délais suffisants pour lui permettre d'exprimer son point de vue et pour permettre à la Commission de prendre dûment en compte, dans la mesure du possible, les vues du Parlement.
Before the Treaty of Lisbon Parliament was only consulted on such conclusions by the Council and such opinions lacked institutional teeth, despite the fact that, according to the current Framework Agreement on relations between the European Parliament and the Commission, the Commission is to provide information at all stages of the process leading up to the conclusion of the agreements and such information has to be provided in sufficient time for Parliament to be able to express its point of view and for the Commission to take Parliament’s views as far as possible into account.

In this debate today, we must likewise remain calm and not give in to the narrow jingoism that some people encourage, but rather focus on creating a better European Union, that European Union which is made up of a Europe of nation states, where those nation states with their own democratically-elected governments determine and decide what they will cooperate in, what they will do and whether they will have laws, directives, framework agreements or merely bilateral agreements.
