24. souligne que la Commission, conformément à la décision n 994/2012/UE établissant un mécanisme d'échange d'informations en ce qui concerne les accords intergouvernementaux conclus entre des États membres et des pays tiers dans le domaine de l'énergie, devrait être informée au préalable de tous les futurs accords intergouvernementaux liés à l'énergie conclus avec des pays tiers, afin de garantir leur conformité avec la législation de l'Union, notamment avec le troisième paquet "Énergie", et de s'assurer qu'ils ne mettent pas en péril la sécurité d'approvisionnement en énergie de l'Union; souligne que ces discussions et consultations doivent servir à renforcer le pouvoir de négociation des États membres et des entreprises de l'Union, dans le respect absolu des informations sensibles d'un point de vue commercial; estime que ces discussions et consultations ne devraient en rien porter préjudice à la teneur des accords, mais garantir qu'ils sont conformes à toutes les législations pertinentes de l'Union et aux intérêts des entreprises et des États membres concernés; invite la Commission à réviser la décision n 994/2012/UE de façon à renforcer le mécanisme d'information en conséquence et à consolider son rôle;

Stresses that the Commission shall be informed of all future intergovernmental energy agreements with non-EU parties in line with Decision No 994/2012/EU establishing an information exchange mechanism with regard to intergovernmental agreements between Member States and third countries in the field of energy ahead of signing in order to make sure that they comply with EU legislation, in particular with the Third Energy Package, and do not threaten EU security of energy supply; highlights that such discussion and consultation must serve as a tool for strengthening the negotiating power of EU Member States and companies, while fully respecting commercially sensitive information; considers that such discussion and consultation should not in any way prejudice the substance and content of agreements, but ensure that they are compliant with all relevant Union law and in the best interests of the companies and Member States concerned; calls on the Commission to revise Decision No 994/2012/EU so as to strengthen the information mechanism accordingly and boost the Commission’s role;

Calls on the Member States to increase their cooperation on the information exchange mechanism with regard to intergovernmental agreements (IGAs) with third countries in the field of energy, in order to increase transparency and leverage their negotiating power vis-à-vis third countries; calls on the Commission to swiftly develop a proposal for obligatory ex ante evaluations of IGAs with regard to their impact on the EU’s internal energy market and their compatibility with EU law; calls on Member States to request the participation of the Commission in the negotiation of energy agreements with non-EU countries; calls on the Commission to develop a template for energy agreements with non-EU countries including clauses relevant to Union interests; calls, in the interest of promoting democracy and transparency, for Parliament to be kept informed by the Commission on a regular basis on energy agreements between the EU and non-EU countries; believes that consideration should be given to the possibility of Member States wishing to do so establishing a collective purchasing mechanism for energy sources in the future;

La réglementation actuelle sur les accords intergouvernementaux a été adoptée en 2012 et elle impose aux États membres de notifier à la Commission leurs accords en matière d'énergie avec des pays tiers seulement après leur conclusion (ex post).
