WHAT DO THE EU TREATIES SAY ABOUT INTERINSTITUTIONAL AGREEMENTS?

L’article 295 du traité sur le fonctionnement de l’Union européenne prévoit que le Parlement européen et le Conseil, entre autres, doivent organiser d’un commun accord les modalités de leur coopération et qu’ils peuvent à cet effet, dans le respect des traités, conclure des accords interinstitutionnels qui peuvent revêtir un caractère contraignant.
Article 295 of the Treaty on the Functioning of the European Union (TFEU) provides that the European Parliament and the Council, inter alia, are to make arrangements for their cooperation and that, to that end, they may, in compliance with the Treaties, conclude interinstitutional agreements which may be of a binding nature.

En particulier, l’article 218, paragraphe 6, du traité sur le fonctionnement de l’Union européenne dispose que, sauf lorsqu’un accord international porte exclusivement sur la politique étrangère et de sécurité commune, le Conseil adopte la décision de conclusion de l’accord concerné après avoir obtenu l’approbation du Parlement européen ou l’avoir consulté. Tous les accords internationaux qui ne portent pas exclusivement sur la politique étrangère et de sécurité commune relèvent donc du présent accord interinstitutionnel.
In particular, Article 218(6) TFEU provides that, except where an international agreement relates exclusively to the common foreign and security policy, the Council is to adopt the decision concluding the agreement in question after obtaining the consent of or consulting the European Parliament; all such international agreements which do not relate exclusively to the common foreign and security policy are therefore covered by this Interinstitutional Agreement.

1.1. Le présent accord interinstitutionnel traite de l'accès du Parlement européen à des informations sensibles, c'est-à-dire classifiées TRÈS SECRET/TOP SECRET, SECRET ou CONFIDENTIEL, quels qu'en soient l'origine, le support ou l'état d'achèvement, détenues par le Conseil dans le domaine de la politique de sécurité et de défense, ainsi que du traitement des documents ayant une telle classification.
1.1. This Interinstitutional Agreement deals with access by the European Parliament to sensitive information, i.e. information classified as TRÈS SECRET/TOP SECRET, SECRET or CONFIDENTIEL, whatever its origin, medium or state of completion, held by the Council in the field of security and defence policy and the handling of documents so classified.

[30] L'accord interinstitutionnel "Mieux légiférer" contient les définitions suivantes: corégulation: “. le mécanisme par lequel un acte législatif communautaire confère la réalisation des objectifs définis par l'autorité législative aux parties concernées reconnues dans le domaine (notamment les opérateurs économiques, les partenaires sociaux, les organisations non gouvernementales ou les associations)"; autorégulation: "la possibilité pour les opérateurs économiques, les partenaires sociaux, les organisations non gouvernementales ou les associations, d'adopter entre eux et pour eux-mêmes des lignes directrices communes au niveau européen (notamment codes de conduite ou accords sectoriels)”.Les règles déterminant le déroulement du dialogue social (articles 138 et 139 du traité CE consolidé) et la normalisation conformément à la "nouvelle approche" ne sont pas concernées par cet accord.
[30] The Interinstitutional Agreement on better lawmaking provides the following definitions: Co-regulation: “. the mechanism whereby a Community legislative act entrusts the attainment of the objectives defined by the legislative authority to parties which are recognised in the field (such as economic operators, the social partners, NGOs or associations)”; Self-regulation: “the possibility for economic operators, the social partners, NGOs or associations to adopt amongst themselves and for themselves common guidelines at European level (particularly codes of practices or sectoral agreements)”. The rules on the functioning of the social dialogue (Articles 138 and 139 TEC) and standardisation according to the “New Approach” are not affected by this agreement.

(8) Un montant de référence financière, au sens du point 34 de l'accord interinstitutionnel du 6 mai 1999 entre le Parlement européen, le Conseil et la Commission sur la discipline budgétaire et l'amélioration de la procédure budgétaire(7) est inséré dans la présente décision pour l'ensemble de la période pendant laquelle le concours financier est accordé, sans que cela n'affecte les compétences de l'autorité budgétaire définies par le traité.
(8) A financial reference, within the meaning of point 34 of the Interinstitutional Agreement of 6 May 1999 between the European Parliament, the Council and the Commission on budgetary discipline and improvement of the budgetary procedure(7), is inserted in this Decision for the entire duration of the period for which financial assistance is to be provided, without thereby affecting the powers of the budgetary authority as defined by the Treaty.
