IN-CONTEXT TRANSLATIONS

CONSIDÉRANT que la Cour de justice des Communautés européennes devrait être compétente dans les mêmes conditions pour statuer sur les questions préjudicielles relatives à la validité et à l’interprétation du présent accord soulevées par une juridiction ou un tribunal danois, et que les juridictions et tribunaux danois devraient donc procéder à des renvois préjudiciels dans les mêmes conditions que les juridictions et tribunaux d’autres États membres s’agissant de l’interprétation des règlements et de leurs mesures d’application,
CONSIDERING that the Court of Justice of the European Communities should have jurisdiction under the same conditions to give preliminary rulings on questions concerning the validity and interpretation of this Agreement which are raised by a Danish court or tribunal, and that Danish courts and tribunals should therefore request preliminary rulings under the same conditions as courts and tribunals of other Member States in respect of the interpretation of the Regulations and their implementing measures.

A Unified Patent Court for the settlement of disputes relating to European patents and European patents with unitary effect is hereby established.

Lorsqu’une question relative à la validité ou à l’interprétation du présent accord est soulevée dans une affaire en instance devant une juridiction danoise, cette juridiction demande à la Cour de justice de se prononcer sur cette question chaque fois que, dans les mêmes circonstances, une juridiction d’un autre État membre de l’Union européenne serait tenue de le faire à l’égard du règlement Bruxelles I et de ses dispositions d’exécution visées à l’article 2, paragraphe 1, du présent accord.

Where a question on the validity or interpretation of this Agreement is raised in a case pending before a Danish court or tribunal, that court or tribunal shall request the Court of Justice to give a ruling thereon whenever under the same circumstances a court or tribunal of another Member State of the European Union would be required to do so in respect of the Brussels I Regulation and its implementing measures referred to in Article 2(1) of this Agreement.

Afin d’accroître la sécurité juridique, la prévisibilité et l’autonomie des parties, le présent règlement devrait permettre aux parties de choisir d’un commun accord la juridiction compétente en fonction de facteurs de rattachement déterminés.
In order to increase legal certainty, predictability and the autonomy of the parties, this Regulation should enable the parties to choose the competent court by agreement on the basis of specific connecting factors.

(8) Il existe un besoin accru de former les juges nationaux à l'application du droit communautaire et de faire en sorte que cette formation soit soutenue par la Communauté, notamment après l'adoption du règlement (CE) no 1/2003 du Conseil du 16 décembre 2002 relatif à la mise en œuvre des règles de concurrence prévues aux articles 81 et 82 du traité [4], qui accorde aux juridictions nationales un pouvoir accru pour appliquer ces dispositions du traité.
(8) There is an increased need to train national judges in the application of Community law and for such training to be supported by the Community, notably following adoption of Council Regulation (EC) No 1/2003 of 16 December 2002 on the implementation of the rules on competition laid down in Articles 81 and 82 of the Treaty [4], which increases the power of national courts to apply these Treaty provisions.
