(28) La directive 2010/75/UE du Parlement européen et du Conseil du 24 novembre 2010 relative aux émissions industrielles[29] cite l’efficacité énergétique parmi les critères appliqués pour déterminer les meilleures techniques disponibles qui devraient servir de référence pour établir les conditions d’autorisation des installations relevant de son champ d’application, y compris les installations de combustion dont la puissance thermique absorbée nominale totale est supérieure ou égale à 50 MW.
(28) Directive 2010/75/EU of the European Parliament and of the Council of 24 November 2010 on industrial emissions[29] includes energy efficiency among the criteria for determining the Best Available Techniques that should serve as a reference for setting the permit conditions for installations within its scope, including combustion installations with a total rated thermal input of 50 MW or more.

6. Les États membres veillent à ce que, lorsqu'une installation existante de production d'électricité d’une puissance thermique absorbée nominale totale supérieure à 20 MW fait l'objet d'un réaménagement substantiel, ou lorsque son autorisation est actualisée conformément à l’article 21 de la directive 2010/75/CE, la nouvelle autorisation ou l’autorisation actualisée contienne la condition que l’installation soit convertie de manière à pouvoir être exploitée comme installation de cogénération à haut rendement, pour autant qu’elle soit située dans un emplacement où la chaleur perdue peut être utilisée par des points de demande de chaleur conformément à l’annexe VIII, point 1.
6. Member States shall ensure that, whenever an existing electricity generation installation with a total rated thermal input exceeding 20 MW is substantially refurbished or when, in accordance with Article 21 of Directive 2010/75/EC, its permit is updated, conversion to allow its operation as a high-efficiency cogeneration installation is set as a condition in the new or updated permit or licence, provided that the installation is sited in a location where the waste heat can be used by heat demand points in accordance with point 1 of Annex VIII.

The Commission’s assessment of the first supplementary report shall include an assessment of the energy efficiency levels of existing and new installations undertaking the combustion of fuels with a total rated thermal input of 50 MW or more and installations undertaking the refining of mineral oil and gas, in the light of the relevant best available techniques as developed in accordance with Directive 2010/75/EU and Directive 2008/1/EC.
