(9) Where a court remits a matter pursuant to this section in relation to a child support order, the court may, pending the making of an order under subsection (7), make an interim order in accordance with the applicable guidelines requiring a spouse to pay for the support of any or all children of the marriage.

La Cour annule, en conséquence, l'arrêt du Tribunal et renvoie l'affaire devant le Tribunal pour qu'il statue suivant cette interprétation du droit communautaire.
The Court of Justice accordingly sets aside the judgment of the Court of First Instance and refers the case back to that Court for judgment in accordance with this interpretation of Community law.

If, however, the Court of Justice finds that the decision of the Court of First Instance affects the unity or consistency of Community law, the Court of Justice will, in the cases provided for in Article 225(2) of the EC Treaty, refer the case back to the Court of First Instance, which will be bound by the points of law decided by the Court of Justice (first subparagraph of point 1 of paragraph 2 of Article 62c).
