Les transactions conclues devant le juge au cours d'un procès et exécutoires dans l'État d'origine lié par la présente convention sont exécutoires dans l'État requis aux mêmes conditions que les actes authentiques.
A settlement which has been approved by a court in the course of proceedings and is enforceable in the State bound by this Convention in which it was concluded shall be enforceable in the State addressed under the same conditions as authentic instruments.

A. considérant que la situation des ONG en Égypte est alarmante; considérant que la création d'un comité chargé de réformer les institutions civiles et les ONG, dans le but de renforcer le contrôle juridique des organisations de la société civile et des fondations politiques recevant des financements étrangers, a été annoncé en octobre 2011 et qu'il a ensuite été demandé à la Banque centrale de contrôler toutes les transactions bancaires des ONG; considérant que les locaux de dix organisations recevant des financements étrangers ont été fouillés et que le Conseil suprême des forces armées a enquêté sur ces organisations puis les a interdites le 29 décembre 2011; considérant que, le 5 février 2012, le gouvernement militaire égyptien a annoncé qu'il traduisait en justice dix-neuf citoyens américains et vingt-quatre autres personnes dans le cadre d'une enquête pénale sur le financement par des capitaux étrangers d'organisations sans but lucratif présentes en Égypte; considérant que les juges égyptiens enquêtent sur le financement prétendument illégal d'ONG promouvant la démocratie et de fondations politiques, que quarante-quatre défendeurs, dont dix-neuf Américains, quatorze Égyptiens, cinq Serbes, deux Allemands, deux Libanais, un Jordanien et un Palestinien, ont vu leurs affaires portées devant le tribunal pénal du Caire et qu'il leur a été ordonné de ne pas quitter le pays;
A. whereas the situation of NGOs in Egypt is alarming; whereas the establishment of a committee to review civil institutions and NGOs, with the aim of tightening legal control over foreign funding of civil society organisations and political foundations, was announced in October 2011 and a request was subsequently made to the Central Bank to monitor all bank transfers to and from NGOs; whereas the offices of 10 foreign-funded organisations were searched and those organisations were investigated and then banned by the Supreme Council of the Armed Forces (SCAF) on 29 December 2011; whereas on 5 February 2012 Egypt's military-led government announced that it was putting 19 American citizens and 24 others on trial as part of a criminal investigation into the foreign financing of non-profit-making organisations active in Egypt; whereas Egyptian judges are investigating alleged illegal foreign financing of pro-democracy NGOs and political foundations, and whereas 44 defendants, including 19 Americans, 14 Egyptians, five Serbs, two Germans, two Lebanese, one Jordanian and one Palestinian, have had their cases referred to the Cairo Criminal Court and ordered not to leave the country;

Les transactions homologuées par un tribunal d’un État contractant désigné dans un accord exclusif d’élection de for ou passées devant ce tribunal au cours d’une instance, et qui sont exécutoires au même titre qu’un jugement dans l’État d’origine, sont exécutées en vertu de la présente convention aux mêmes conditions qu’un jugement.
Judicial settlements (transactions judiciaires) which a court of a Contracting State designated in an exclusive choice of court agreement has approved, or which have been concluded before that court in the course of proceedings, and which are enforceable in the same manner as a judgment in the State of origin, shall be enforced under this Convention in the same manner as a judgment.

Dans la mise en œuvre de cette coordination, les autorités compétentes devraient tenir compte: de la nécessité de surveiller efficacement les activités des entreprises d'investissement dans l'optique de veiller à ce que celles-ci agissent d'une manière honnête, équitable et professionnelle, propre à promouvoir l'intégrité du marché dans la Communauté, de la nécessité de décisions fondées sur une analyse coût-bénéfice approfondie, de la nécessité d'assurer que les informations concernant les transactions servent uniquement à la bonne exécution des missions des autorités compétentes et, enfin, de la nécessité de soumettre tout système commun jugé nécessaire à des règles de gouvernance efficaces et plaçant chacun devant ses responsabilités.
In carrying out the coordination, competent authorities should consider the need to monitor the activities of investment firms effectively, so as to ensure that they act honestly, fairly and professionally and in a manner which promotes the integrity of the market in the Community, the need for decisions to be based on a thorough cost-benefit analysis, the need to ensure that transaction information is used only for the proper discharge of the functions of competent authorities and finally the need to have effective and accountable governance arrangements for any common system that might be considered necessary.
