(Return tabled) Question No. 199 Ms. Kirsty Duncan: With regard to the development and operation of the Canadian Multiple Sclerosis Monitoring System (CMSMS) announced in March 2011: (a) what are the government's baseline assumptions for the CMSMS, (i) how many Canadians live with MS according to the government’s source, (ii) what is the government's source; (b) what have been the challenges in developing the system between March 2011 and today, (i) how has each challenge been overcome, (ii) what are the achievements to date, (iii) what milestones has the government planned between December 2013 and December 2015 and by what dates; (c) what is the cost of developing the system, broken down by costs to date; (d) how much money did the Canadian Institutes for Health Research (CIHR) contribute to the development of the CMSMS, (i) were there any other partners involved in the development of the system, (ii) if so, who are they, (iii) what has each contributed; (e) who was involved in the design and development of the CMSMS, (i) from what departments/institutions were they, (ii) were potential conflicts of interest declared and, if so, how; (f) what health information does the CMSMS track, specifically, with regard to (i) chronic cerebrospinal venous insufficiency (CCSVI), (ii) impacts of CCSVI treatment, including but not limited to use of the following scales, Expanded Disability Status Scale, Modified Fatigue Impact Scale, Multiple Sclerosis Impact Scale, and Multiple Sclerosis Quality of Life Inventory, (iii) pharmaceutical treatments for MS, (vi) adverse drug reactions by MS drug; (g) who is/was overseeing pilot testing, (i) who is/was responsible for ensuring that patient information is/was protected, (ii) who is/was responsible for the integrity of the results; (h) were ethical reviews for pilot testing necessary and, if so, on what date did each pilot site pass ethical review; (i) when is pilot testing expected to/did it take place and at which MS clinics ...

Acknowledges from the Court of Auditors' report that the Agency could improve its recruitment procedures in order to fully ensure transparency and equal treatment of candidates; calls on the Agency to inform the discharge authority of the actions taken to improve the recruitment procedures; considers that some of the provisions of the Staff Regulations may present a considerable administrative burden; encourages, therefore, the Commission to allow for a certain degree of simplification under Article 110 of the Staff Regulations in regard to the agencies;

Question No. 204 Ms. Dawn Black: With regard to detainee handling in Afghanistan: (a) at what time was Canada first granted formal access to Afghan monitor detention facilities in Kandahar; (b) how many Correctional Service of Canada (CSC) officers were in Kandahar in August 2005, and what was the number for each month since; (c) did CSC direct their officers to specifically monitor detainees taken by Canadians and held in Afghan custody, and, if so, what form did that direction take; (d) what type of investigation was begun by the Department of National Defence and the Canadian Forces following the publishing of reports of torture in the Globe and Mail on Monday, April 23, 2007, and when was it commenced; (e) what is the number of detainees transferred to Afghan custody since the signing of the December 18, 2005, “Arrangement for the Transfer of Detainees Between the Canadian Forces and the Ministry of Defence of the Islamic Republic of Afghanistan”; (f) following the processing of transfer documents and the release of a detainee to Afghan authorities, how are National Defence Headquarters, the Chief of the Defence Staff (CDS) and the Minister of National Defence informed of this transfer respectively; (g) when was information about the Department of Foreign Affairs country reports, starting in 2002, describing torture and inhumane treatment in Afghan prisons as “common”, first released outside of the Department and when were i) the current and previous Foreign Affairs Ministers made aware, ii) the current and previous Defence Ministers made aware, iii) the current and previous Prime Ministers made aware; (h) when were negotiations begun on the arrangement for monitoring access announced by the Minister of National Defence on Wednesday April 25, 2007, and i) when were negotiations concluded, ii) when was the CDS made aware of the arrangement, iii) when was the Minister of Foreign Affairs made aware of the arrangement, iv) when was the Prime Minister made awa ...

Notes that, with regard to recruitment, the Agency does not accept the ECA's criticism that it did not respect the principle of equal treatment as the minimum years of professional experience required for a given position differed from those agreed between the Commission and the agencies; notes that the Agency considers its practice to be in line with the rules, as it had to attract highly specialised staff under difficult conditions; observes that the Staff Regulations stipulate that Community agencies have to adopt their general implementing provisions (GIP) in agreement with the Commission; notes that the Commission has drafted model decisions for the GIP; notes that the Commission has not yet agreed to the draft GIP submitted by the Agency; calls on the Agency, in agreement with the Council recommendation, to strictly respect the recruitment criteria in the Staff Regulations in order to ensure equal treatment with regard to the years of professional experience required for a given post;

Specifically, the arrangement includes a commitment to treat detainees humanely and in accordance with the standards set out for prisoners of war in the Third Geneva Convention, which affords detainees with the highest treatment standard regardless of their status and obviates the need for status determination; an acknowledgment of the right of the ICRC to visit detainees at any time during their custody; an obligation for both parties to notify the ICRC upon transferring a detainee, in accordance with their obligations pursuant to international law; a commitment that persons transferred from the Canadian Forces to Afghan authorities will not be subject to the application of the death penalty; and lastly, a recognition by both parties of the legitimate role of the Afghan Independent Human Rights Commission with regard to the treatment of detainees.
