TRADUCTIONS EN CONTEXTE

déplore que l'accès aux informations détenues par les institutions de l'Union reste difficile pour les citoyens, en raison de l'absence d'approche commune entre les institutions axée sur la facilitation de l'accès aux documents pour les citoyens, la transparence totale et effective, la communication et la démocratie directe; encourage les institutions, les organes, les bureaux et les agences de l'Union à adopter une approche plus volontaire de la transparence en rendant accessibles, de leur propre initiative, le plus grand nombre possible de documents en leur possession, d'une manière simple et à la portée du public, en garantissant leur traduction sur demande dans toutes les langues officielles de l'Union et en prévoyant des modalités d'accès aux informations simples et non coûteuses, notamment par voie numérique et informatique, qui tiennent compte des besoins des personnes handicapées; considère notamment que l'accessibilité de l'information doit être améliorée en rendant les interfaces et les systèmes de recherche plus faciles d'utilisation; demande la création d'un point d'accès commun aux portails des trois institutions, qui s'inspire du projet pilote de plateforme en ligne pour la pour la publication proactive des documents des institutions de l’Union et l'harmonisation des portails de recherche entre les départements d'une même institution (notamment les Directions générales de la Commission); appelle également les institutions à poursuivre et renforcer le travail de vulgarisation de la législation et des politiques européennes; est d'avis que l'Union devrait pour cela faire plein usage des potentialités offertes par les nouvelles technologies (réseaux sociaux, applications pour smartphones, etc.), afin d'assurer une accès complet et aisé à l'information.
Regrets that it is still difficult for citizens to gain access to information held by EU institutions, the reason being that there is no common approach among the institutions geared to facilitate access to documents for citizens and based on complete transparency, communication and direct democracy; urges the EU institutions, bodies, offices and agencies to develop further a more proactive approach on transparency by proactively disclosing as many of their documents as possible, in the most simple, user-friendly and accessible way, by having documents translated upon request into other EU official languages, and by establishing proper, simple and inexpensive information access arrangements, including by digital and electronic means, allowing for the needs of people with disabilities; considers, in particular, that the accessibility of information should be improved on by means of easy-to-use interfaces and search systems; calls for the development of a common access point to the portals of the three institutions, building on the pilot project for the online platform for the proactive publication of EU institutions documents, and for harmonising search portals between departments of the same institution (including Directorates-General in the Commission); calls, as well, on the institutions to continue and strengthen the work of expanding knowledge of EU legislation and policies; believes that, to that end, the EU should make full use of the potential offered by new technologies (social networks, smartphone applications, etc.) in order to ensure complete and easy access to information.

Ces modalités de traduction maintiendraient la possibilité de déposer une demande de brevet auprès de l’OEB dans n’importe quelle langue de l’Union et assureraient le remboursement des coûts liés à la traduction des demandes déposées dans une langue autre que l’une des langues officielles de l’OEB.
The translation arrangements would maintain the possibility of filing patent applications in any language of the Union at the EPO, and would ensure compensation of the costs related to the translation of applications filed in languages other than an official language of the EPO.

L’OEB gérera les demandes d’effet unitaire, inscrira au Registre européen des brevets les entrées relatives aux brevets européens à effet unitaire et administrera ces entrées, recevra et enregistrera les déclarations relatives aux licences, assurera la publication des traductions requises pendant la période de transition, collectera et gérera les taxes annuelles (ainsi que les surtaxes) et gérera la redistribution d’une partie des taxes ainsi collectées aux États membres participants, et gérera un système de compensation des coûts de traduction pour les demandeurs déposant des demandes de brevet dans une langue officielle de l’Union qui n’est pas l’une des langues officielles de l’OEB.
The EPO shall administer requests for unitary effect, include and administer in the European Patent Register entries relating to European patents with unitary effect, receive and register statements on licensing, ensure the publication of the translations required during the transitional period, collect and administer the renewal fees (as well as additional fees), the distribution of a part of the collected renewal fees to the participating Member States and administer a compensation scheme of translation costs for applicants filing European patent applications in one of the official languages of the Union that is not an official language of the EPO.

Si la langue choisie, conformément au paragraphe 5, pour l'acte d'opposition ou la demande en déchéance ou en nullité n'est ni la langue de la demande de marque ni la deuxième langue indiquée lors du dépôt de cette demande, l'opposant ou le requérant en déchéance ou en nullité est tenu de produire à ses frais une traduction de son acte soit dans la langue de la demande de marque, à condition qu'elle soit une langue de l'Office, soit dans la deuxième langue indiquée lors du dépôt de la demande de marque; la traduction est produite dans le délai prévu par le règlement d'exécution.
If the language chosen, in accordance with paragraph 5, for the notice of opposition or the application for revocation or invalidity is neither the language of the application for a trade mark nor the second language indicated when the application was filed, the opposing party or the party seeking revocation or invalidity shall be required to produce, at his own expense, a translation of his application either into the language of the application for a trade mark, provided that it is a language of the Office, or into the second language indicated when the application was filed.

2. L'indemnité raisonnable n'est due que si le demandeur a soit remis à la personne exploitant l'invention, soit déposé auprès de l'Office, une traduction que l'Office a rendu accessible au public, des revendications dans la langue officielle de l'Etat membre où la personne exploitant l'invention a son domicile ou son siège ou, dans le cas d'un Etat ayant plusieurs langues officielles, celle que cette personne a acceptée ou désignée, sous réserve que l'exploitation contestée constitue une contrefaçon de la demande selon le texte original de la demande, ainsi que selon le texte de la traduction.
2. Reasonable compensation shall be due only if the applicant has either communicated to the person using the invention or filed with the Office a translation of the claims which the Office has made available to the public and which is in the official language of the Member State in which the person using the invention has his residence or principal place of business or, where that State has more than one official language, in the language which that person has accepted or designated, provided that the contested use constitutes infringement of the application according to the original text of the application and according to the text of the translation.

Si cela est approprié en raison de la longueur de la demande, cette traduction est remplacée par la traduction dans la langue officielle de l'État destinataire d'un résumé de cette demande, lequel servira de base à la prise de position de cet État.
Where appropriate, on account of the length of the request, such translation shall be replaced by the translation into the official language of the State to which it is addressed of a summary of that request, which will serve as a basis for the position to be adopted by that State.
