La Commission a décidé d'adresser à la France un avis motivé pour avoir enfreint tant les articles 39, 43 et 49 du traité CE que la directive 92/51/CEE relative au système général de reconnaissance de diplômes en refusant aux guides de canyon d'autres Etats membres d’exercer cette seule activité en France au motif qu'en France l'accès à cette activité est réservé aux guides de montagne, aux spéléologues ou aux moniteurs d'alpinisme.
The Commission has decided to send a reasoned opinion to France for its breach of Articles 39, 43 and 49 of the EC Treaty and Directive 92/51/EEC on the general system for the recognition of diplomas by refusing to allow canyoning guides from other Member States to pursue this specific activity in France on the grounds that in France this activity can only be practised by mountain guides, potholers or mountaineering instructors.
