(1) Si le contrat prévoit que l’acheteur doit spécifier la forme, la mesure ou d’autres caractéristiques des marchandises et si l’acheteur n’effectue pas cette spécification à la date convenue ou dans un délai raisonnable à compter de la réception d’une demande du vendeur, celui-ci peut, sans préjudice de tous autres droits qu’il peut avoir, effectuer lui-même cette spécification d’après les besoins de l’acheteur dont il peut avoir connaissance.
(1) If under the contract the buyer is to specify the form, measurement or other features of the goods and he fails to make such specification either on the date agreed upon or within a reasonable time after receipt of a request from the seller, the seller may, without prejudice to any other rights he may have, make the specification himself in accordance with the requirements of the buyer that may be known to him.

19 (1) Avant de passer un contrat pour la construction d’une cale flottante sous le régime de la présente loi, le gouverneur en conseil doit s’assurer, moyennant l’avis d’ingénieurs experts, quel sera le temps probable durant lequel, avec un entretien adéquat, cette cale flottante sera en état de service pour la réception et la réparation des navires, comme prévu par la présente loi.
19 (1) Before entering into an agreement for the construction of a floating dry dock under this Act, the Governor in Council shall ascertain from expert engineering opinion what the probable time will be during which the floating dry dock, with reasonable maintenance, will be serviceable for the reception and repairing of vessels as contemplated by this Act.

3 (1) The Governor in Council may, as an aid to the construction of any dry dock, authorize the payment out of any unappropriated money forming part of the Consolidated Revenue Fund of a subsidy, in accordance with this Act, to any incorporated company, approved by the Governor in Council as having the ability to perform the work, that enters into an agreement with Her Majesty to construct a dry dock under this Act, with all necessary equipment, machinery and plant, for the reception and repairing of vessels.

13. Considers that the Regulation should contain a new provision dealing with the opposability of choice-of-court agreements against third parties; takes the view that such provision could provide that a person who is not a party to the contract will be bound by an exclusive choice-of-court agreement concluded in accordance with the Regulation only if: (a) that agreement is contained in a written document or electronic record; (b) that person is given timely and adequate notice of the court where the action is to be brought; (c) in contracts for carriage of goods, the chosen court is (i) the domicile of the carrier; (ii) the place of receipt agreed in the contract of carriage; (iii) the place of delivery agreed in the contract of carriage, or (iv) the port where the goods are initially loaded on a ship or the port where the goods are finally discharged from a ship; considers that it should further be provided that, in all other cases, the third party may bring an action before the court otherwise competent under the Regulation if it appears that holding that party to the chosen forum would be blatantly unfair;
