Lorsque les entités adjudicatrices font usage de la possibilité de se référer aux spécifications visées au paragraphe 3, premier alinéa, elles ne peuvent cependant pas rejeter une offre au motif que les produits et services offerts sont non conformes à une norme nationale transposant une norme européenne, à un agrément technique européen, à une spécification technique commune, à une norme internationale, ou à une norme nationale, une spécification techniques nationale ou à un agrément technique national, lorsque le soumissionnaire démontre dans son offre, par tout moyen approprié, que les solutions qu'il propose satisfont de manière équivalente aux exigences définies par la spécification technique de référence.
5. Where a contracting entity makes use of the possibility of referring to the specifications mentioned in the first subparagraph of paragraph 3, it cannot, however, reject a tender on the grounds that the products and services tendered for do not comply with a national standard transposing a European standard, with a European technical approval, a common technical specification, an international standard, or a national standard, a national technical specification or a national technical approval, where the tenderer can show in his offer, by any appropriate means, that the solutions he proposes satisfy in an equivalent manner the requirements defined by the technical specifications.

3. If the relevant European technical specifications, either themselves or on the basis of the interpretative documents referred to in Article 3 (3), distinguish between different classes corresponding to different performance levels, Member States may determine the performance levels also to be observed in their territory only within the classifications adopted at Community level and only subject to the use of all or some classes or one class.
