Aux seules fins de ce calcul, la société holding d’assurance intermédiaire ou la compagnie financière holding mixte intermédiaire est traitée comme une entreprise d’assurance ou de réassurance soumise aux règles énoncées au titre I, chapitre VI, section 4, sous-sections 1, 2 et 3, en ce qui concerne le capital de solvabilité requis, et aux mêmes conditions que celles énoncées au titre I, chapitre VI, section 3, sous-sections 1, 2 et 3, en ce qui concerne les fonds propres éligibles en couverture du capital de solvabilité requis.
For the sole purpose of that calculation, the intermediate insurance holding company or intermediate mixed financial holding company shall be treated as if it were an insurance or reinsurance undertaking subject to the rules laid down in Subsections 1, 2 and 3 of Section 4 of Chapter VI of Title I in respect of the Solvency Capital Requirement and were subject to the same conditions as are laid down in Subsections 1, 2 and 3 of Section 3 of Chapter VI of Title I in respect of own funds eligible for the Solvency Capital Requirement.

2. 2. For the purpose of that calculation, the parent undertaking shall be treated as if it were an insurance or reinsurance undertaking subject to the rules laid down in Subsections 1, 2 and 3 of Section 4 of Chapter VI of Title I as regards the Solvency Capital Requirement and subject to the same conditions as laid down in Subsections 1, 2 and 3 of Section 3 of Chapter VI of Title I as regards the own funds eligible for the Solvency Capital Requirement’.

Success will depend critically upon how well this change is managed. From this perspective, the Commission and Council should also ensure that topics such as the right to information and consultation, revision of the law on works councils and the role of employees and citizens in mergers and business closures with their serious social consequences can be brought up for discussion sooner rather than later.
