IN-CONTEXT TRANSLATIONS

reconnaître que la protection des données et le droit à la vie privée ne sont pas des obstacles aux échanges, mais des droits fondamentaux, consacrés à l'article 39 du traité UE, aux articles 7 et 8 de la charte des droits fondamentaux de l'Union européenne, ainsi qu'à l'article 12 de la déclaration universelle des droits de l'homme; reconnaître qu'un niveau élevé de confiance est essentiel en vue de développer une économie axée sur les données; garantir le plein respect de ce droit fondamental, en tenant dûment compte de l'évolution récente de l'économie numérique, et en pleine conformité avec la décision de la Cour de justice de l'Union européenne sur l'accord relatif à la sphère de sécurité; incorporer une disposition de portée générale, dépourvue d'ambiguïté, transversale, autonome et juridiquement contraignante, fondée sur l'article XIV de l'AGCS, qui exclue totalement du champ d'application de cet accord le cadre juridique actuel et futur de l'Union sur la protection des données à caractère personnel, sans qu'aucune condition n'exige que celui-ci soit en cohérence avec d'autres éléments de l'ACS; appliquer ces dispositions à toutes les autres annexes de l'ACS; soutenir sans délai et formellement ce type de propositions dans le cadre de l'annexe de l'ACS relative au commerce en ligne; appuyer les propositions visant à garantir l'application non discriminatoire des cadres juridiques nationaux de protection des données à caractère personnel des utilisateurs; appliquer les dispositions concernant la protection des données contenues dans l'annexe relative au commerce en ligne à toutes les autres annexes à l'ACS, y compris en ce qui concerne les services financiers;
to acknowledge that data protection and the right to privacy are not a trade barrier, but fundamental rights, which are enshrined in Article 39 TEU and Articles 7 and 8 of the Charter of Fundamental Rights of the European Union, as well as in Article 12 of the Universal Declaration of Human Rights; to acknowledge that a high level of trust is essential to develop a data-driven economy; to guarantee full respect of this fundamental right, taking due account of recent developments in the digital economy and in full compliance with the European Court of Justice's ruling with respect to Safe Harbour; to incorporate a comprehensive, unambiguous, horizontal, self-standing and legally binding provision based on GATS Article XIV which fully exempts the existing and future EU legal framework for the protection of personal data from the scope of this agreement, without any conditions that it must be consistent with other parts of the TiSA; to apply such provisions to all other TiSA annexes; to immediately and formally support such proposals in the TiSA e-commerce annex; to support proposals aimed at ensuring that domestic legal frameworks for the protection of personal information of users are applied on a non-discriminatory basis; to apply the data protection provisions enshrined in the annex on e-commerce to all other TiSA annexes, including on financial services;

1. souligne que l'évolution rapide du progrès technologique dans la société de l'information à l'échelle mondiale implique l'adoption de règles détaillées et cohérentes sur la protection des données; observe que, suite à l'entrée en vigueur du traité de Lisbonne, et compte tenu du fait que la Charte des droits fondamentaux est devenue juridiquement contraignante, l'article 16 du traité sur le fonctionnement de l'Union européenne (TFUE) pourrait offrir une base juridique spécifique pour l'adoption d'un instrument juridique concernant la protection des données personnelles, sous réserve qu'elle se fonde sur le degré le plus élevé de protection offert par la législation de l'UE, ce qui conférera une sécurité juridique accrue; considérant que l'article 8 de la Charte doit être, à cet égard, pleinement respecté;
1. Stresses that the rapid pace of technological development in the global information society calls for comprehensive and coherent rules on data protection; notes that, following the entry into force of the Lisbon Treaty and the Charter of Fundamental Rights becoming legally biding, Article 16 of the Treaty on the Functioning of the European Union (TFEU) could provide a specific legal basis for the adoption of one legal instrument on the protection of personal data, if based on the highest level of protection provided for in EU legislation, and that this would provide greater legal certainty; whereas Article 8 of the Charter must be fully complied with in this respect;

In their Resolution, the European Data Protection Commissioners consider that all these developments offer tremendous opportunities for a real improvement of the data protection framework, offering effective protection to all individuals under all circumstances, not only now but also in a more distant future.

updating, on the basis of recent ECJ case-law, the rules which deal in particular with the treatment of internal documents, information and data, to ensure wider access to Legal Service opinions drafted within the framework of the decision-making process, documents and information relating to the work of Member State representatives when acting as members of the Council - including the acts, proposals and amendments tabled, transcripts of meetings, their positions and votes cast in the Council, including in its working groups and expert groups - documents relating to international agreements, the protection of personal data and commercial interests, the content of the institutions' registers, etc.;

(c) en mettant à jour, sur la base de la jurisprudence récente de la CJCE, les règles relatives, notamment, au traitement des documents, informations et données internes, afin de garantir un accès plus large aux avis du service juridique rédigé dans le cadre du processus de prise de décision, aux documents et informations relatifs aux États membres lorsqu'ils agissent en tant que membre du Conseil (y compris les actes, les propositions et les amendements déposés, les comptes rendus des réunions du Conseil, les positions et les votes exprimés par les États membres au sein du Conseil, notamment dans ses groupes de travail et groupes d'experts), à la protection des données personnelles et des intérêts commerciaux, au contenu des bases de données des institutions, etc.;
(c) updating, on the basis of the recent case law of the ECJ, the rules dealing notably with the treatment of internal documents, information and data, to ensure wider access to Legal Service opinions drafted in the framework of the decision-making process, documents and information relating to Member States when acting as members of the Council - including the acts, proposals and amendments tabled, transcripts of its meetings, their positions and votes cast in the Council, including in its working groups and expert groups - the protection of personal data and commercial interests, the content of the institutions' databases, etc.;
