Recalls that the Joint Undertaking was set up in February 2007; welcomes the fact that in 2012, the Commission’s Internal Audit Service and the Joint Undertaking’s internal auditing function started to implement the Coordinated Internal Audit Service (IAS) Strategic Audit Plan for the Joint Undertaking for the period 2012-2014; notes that the IAS carried out a programme/project audit and an IT risk assessment while the SESAR IAC examined three calls for tenders and audited the implementation of four internal control standards; expects that the IAS follows the budget expenditure closely, namely the assessment of in-kind contributions and the payments made to the Joint Undertaking’s 15 members on programme activities involving more than 100 private and public entities and subcontractors;

Welcomes that, in accordance with Article 86(4) of the Financial Regulation, the agencies forward a summary of the IAS findings to Parliament; reiterates that reports drafted by the IAS are internal and not public documents; notes, further, that this also applies to separate annual reports on the agencies and other bodies; welcomes any cooperation on the part of the agencies to make available those reports upon a specific and justified request by Parliament; urges the Interinstitutional Working Group on Agencies to address the flaw in the legislation concerning IAS reports on the agencies and to propose a solution;

Afin de pouvoir évaluer si l'objectif d'un service international est le transport de voyageurs sur un trajet entre des gares situées dans des États membres différents et quelle est l'incidence économique potentielle sur les contrats de service public existants, les organismes de contrôle veillent à ce que toute autorité compétente ayant attribué un service ferroviaire de transport de voyageurs sur ce trajet défini dans un contrat de service public, toute autre autorité compétente concernée ayant le droit de limiter l'accès en vertu de l'article 11 et toute entreprise ferroviaire exécutant le contrat de service public sur le trajet de ce service international de transport de voyageurs soient informées.
In order to enable them to assess whether the purpose of the international service is to carry passengers on a route between stations located in different Member States, and what the potential economic impact on existing public service contracts is, regulatory bodies shall ensure that any competent authority that has awarded a rail passenger service on that route defined in a public service contract, any other interested competent authority with a right to limit access under Article 11 and any railway undertaking performing the public service contract on the route of that international passenger service is informed.

Dans le cas où un service international par autocars et autobus existant affecte sérieusement, sur les tronçons directs concernés, la viabilité d’un service comparable couvert par un ou plusieurs contrats de service public conformes au droit communautaire à la suite de circonstances exceptionnelles impossibles à prévoir lorsque l’autorisation a été accordée, un État membre peut, avec l’accord de la Commission, suspendre ou retirer l’autorisation d’exploiter le service international d’autobus et d’autocars après avoir donné un préavis de six mois au transporteur.
In the event that an existing international coach and bus service is seriously affecting the viability of a comparable service covered by one or more public service contracts conforming to Community law on the direct sections concerned, due to exceptional reasons which could not have been foreseen at the time of granting the authorisation, a Member State may, with the agreement of the Commission, suspend or withdraw the authorisation to run the international coach and bus service after having given 6 months’ notice to the carrier.

In order to enable the assessment of the purpose of the international service to carry passengers between stations located in different Member States, and the potential economic impact on existing public service contracts, regulatory bodies shall ensure that any competent authority that has awarded a rail passenger service defined in a public service contract, any other interested competent authority with a right to limit access under Article 10(3b) of Directive 91/440/EEC and any railway undertaking performing the public service contract on the route of this international passenger service is informed’.

The Joint Undertaking, which should be responsible for public research activities of European and international interest, and discharge commitments pursuant to international agreements, should be considered as an international body within the meaning of Article 151(1)(b) of Council Directive 2006/112/EC of 28 November 2006 on the common system of value added tax , and as an international organisation within the meaning of the second indent of Article 23(1) of Council Directive 92/12/EEC of 25 February 1992 on the general arrangements for products subject to excise duty and on the holding, movement and monitoring of such products , Article 22 of Directive 2004/17/EC of the European Parliament and of the Council of 31 March 2004 coordinating the procurement procedures of entities operating in the water, energy, transport and postal services sectors , and Article 15 of Directive 2004/18/EC of the European Parliament and of the Council of 31 March 2004 on the coordination of procedures for the award of public works contracts, public supply contracts and public service contracts

(c) "publicly available telephone service" means a service available to the public for originating and receiving national and international calls and access to emergency services through a number or numbers in a national or international telephone numbering plan, and in addition may, where relevant, include one or more of the following services: the provision of operator assistance, directory enquiry services, directories, provision of public pay phones, provision of service under special terms, provision of special facilities for customers with disabilities or with special social needs and/or the provision of non-geographic services.
