TRADUCTIONS EN CONTEXTE

1. Le 23 février 2018, une Conférence internationale de Haut niveau sur le Sahel s'est tenue à Bruxelles sous l'égide du Président de la République du Niger, Président en exercice du G5 Sahel, Issoufou Mahamadou, du Président de la Commission de l'Union Africaine, Moussa Faki Mahamat, du Secrétaire Général des Nations Unies, António Guterres et du président de la Commission européenne, Jean-Claude Juncker, au terme de laquelle les conclusions suivantes ont été tirées :
1. On 23 February 2018 an international high-level conference on the Sahel was held in Brussels under the aegis of Mahamadou Issoufou, President of the Republic of Niger and President-in-office of the G5 Sahel, Moussa Faki Mahamat, Chairperson of the African Union Commission, António Guterres, Secretary-General of the United Nations and Jean-Claude Juncker, President of the European Commission, at the end of which the following conclusions were drawn:

Moreover, the power given to the President of the Republic to appoint an acting President of the Tribunal appears to be contrary to the constitution which provides that the President and Vice-President of the Tribunal shall be appointed by the President of the Republic "from amongst candidates proposed by the General Assembly of the Judges of the Constitutional Tribunal", while the procedure in the Implementing Law denies any such role to the General Assembly.

Enfin, l'élection des candidats par six juges seulement est incompatible avec la décision du Tribunal du 7 novembre 2016, selon laquelle l'article 194, paragraphe 2, de la constitution doit être interprété comme disposant que le président du Tribunal est nommé par le président de la République parmi les candidats ayant obtenu une majorité de votes à l'assemblée générale du Tribunal.
Finally, the election of candidates by six judges only is incompatible with the judgment of the Tribunal of 7 November 2016 according to which Article 194(2) of the constitution must be understood as providing that the President of the Tribunal shall be appointed by the President of the Republic from amongst candidates which have obtained a majority vote in the General Assembly of the Tribunal.
