NATO has argued that not only does its humanitarian intervention meet all of these conditions, but that the UN Charter and the doctrine of state sovereignty cannot be used as a cover for the killing of one's own citizens; that the Security Council and recent international jurisprudence from the International Criminal Tribunal regarding the former Yugoslavia and Rwanda have determined that the doctrine of humanitarian intervention applies to internal as well as to international conflict; that the cases of intervention in Haiti, Somalia, Rwanda and Iraq only reinforce this view; and, most important, that the UN Security Council has determined under its Chapter VII authority that the Kosovo situation constitutes a threat to international peace and security and, by a 12-3 vote, overwhelmingly rejected a resolution that the bombing was illegal.

Concerning the Democratic Republic of Congo, the Council has declared its active support of the renewed peace efforts based on the agreement of Lusaka concerning the ceasefire and on the relevant resolutions of the UN Security Council. The Council has closely followed the situation in Rwanda and on 19 November specified a new collective standpoint with regard to Rwanda. Concerning Burundi, the Council provided intense diplomatic endeavours in support of the formation, on 1 November 2001, of an interim government of national unity.

Cools: Honourable senators, pursuant to rule 56(1)(2) and 57(2), I give notice that, in two days' time, I will call the attention of the Senate to the military invasion of Rwanda by the Rwandese Patriotic Army, RPA, and the Ugandan National Resistance Army, the NRA, on October 1, 1990; and to the deaths of the Rwandese President Juvénal Habyarimana and Burundi President Cyprien Ntaryamira in an aeroplane crash on April 6, 1994, and the situation in Rwanda; and to the United Nations Security Council Resolution 955(1994) constituting the United Nations War Crimes Tribunal for Rwanda whose Chief Prosecutor is Justice Louise Arbour, a Canadian judge; and to the legal and constitutional foundations in international law for this and like tribunals; and to the prosecution of accused Rwandan citizens for violations of humanitarian law and war crimes during the period January 1 to December 31, 1994; and to my visit to Arusha, Tanzania, as prompted by the International Lawyers Organization, which includes barrister Ramsey Clark, former Attorney General of the United States of America, and barrister Luc De Temmerman of Belgium, to observe the operations of the United Nations War Crimes Tribunal for Rwanda.
