I am also most grateful to Mrs McCarthy and Mrs Fourtou for informing us that the CE mark and its significance did not just begin to exercise this Parliament when the framework legislation on the new approach was adopted but that, whenever a directive relating to the CE mark has been discussed in recent years, we have repeatedly asked whether the CE mark – which, as we know, was originally intended purely as a marking for market-surveillance bodies – really tells consumers what they want to know when they buy a product.

Member States shall refrain from referring in their national legislation, and shall remove any existing references, to a conformity mark other than the CE marking in connection with full conformity to the provisions of Community legislation on the CE marking.

Urges the Commission and the Member States to defend consumer rights and expectations through strict enforcement of product safety laws, particularly toy safety laws, and to step up efforts to improve market surveillance, national inspections and bans on dangerous products of unidentified origin, and to prevent non-compliant and unsafe products from being placed on the market or to ensure that they are withdrawn or recalled from the market, including when there is evidence of deceptive behaviour and/or use of fraudulent or misleading origin markings by foreign producers and importers;

To be granted a refund, the products listed in Article 1 of Regulation (EC) No 1255/1999 must meet the relevant requirements of Regulation (EC) No 852/2004 of the European Parliament and of the Council (12) and Regulation (EC) No 853/2004 of the European Parliament and of the Council (13), notably preparation in an approved establishment and compliance with the identification marking requirements specified in Section I of Annex II to Regulation (EC) No 853/2004.

Sans préjudice de l'article 10 , si les autorités compétentes établissent que le marquage CE a été appliqué indûment, le fabricant ou son mandataire établi dans la Communauté doit mettre les appareils en cause en conformité avec les dispositions relatives au marquage CE dans les conditions imposées par l'État membre concerné.

Without prejudice to Article 10 , if a competent authority establishes that the CE marking has been unduly affixed, the manufacturer or his authorised representative established within the Community shall bring the apparatus into conformity with the provisions concerning the CE marking under conditions imposed by the Member State concerned.
