En ce qui concerne le transport maritime international, y compris les opérations intermodales comportant un trajet maritime, bénéficient également des dispositions du présent chapitre et du chapitre III, les ressortissants des États membres ou de la République du Tadjikistan, établis hors de la Communauté ou de la République du Tadjikistan respectivement, et les compagnies de navigation établies hors de la Communauté ou de la République du Tadjikistan et contrôlées par des ressortissants d'un État membre ou de la République du Tadjikistan, si leurs navires sont immatriculés dans cet État membre ou dans la République du Tadjikistan conformément à leurs législations respectives.
With regard to international maritime transport, including intermodal operations involving a sea leg, nationals of the Member States or of the Republic of Tajikistan established outside the Community or the Republic of Tajikistan respectively, and shipping companies established outside the Community or the Republic of Tajikistan and controlled by nationals of a Member State or nationals of the Republic of Tajikistan respectively, shall also be beneficiaries of the provisions of this Chapter and Chapter III if their vessels are registered in that Member State or in the Republic of Tajikistan respectively in accordance with their respective legislation.

Le règlement (CE) no 1383/2003 ayant remplacé le règlement (CE) no 3295/94 du Conseil du 22 décembre 1994 fixant certaines mesures concernant l’introduction dans la Communauté et l’exportation et la réexportation hors de la Communauté de marchandises portant atteinte à certains droits de propriété intellectuelle , il convient de remplacer le règlement (CE) no 1367/95 de la Commission qui a arrêté les dispositions d’application du règlement (CE) no 3295/94.
Since Regulation (EC) No 1383/2003 replaced Council Regulation (EC) No 3295/94 of 22 December 1994 laying down measures concerning the entry into the Community and the export and re-export from the Community of goods infringing certain intellectual property rights , it is also necessary to replace Commission Regulation (EC) No 1367/95 , which laid down provisions for the implementation of Regulation (EC) No 3295/94.

(b) in paragraph 2, the following point shall be added: "(f) the place where services referred to in the last indent of subparagraph (e) are supplied when performed for non-taxable persons who are established, have their permanent address or usually reside in a Member State, by a taxable person who has established his business or has a fixed establishment from which the service is supplied outside the Community or, in the absence of such a place of business or fixed establishment, has his permanent address or usually resides outside the Community, shall be the place where the non-taxable person is established, has his permanent address or usually resides".

In the case of telecommunications services and radio and television broadcasting services referred to in paragraph 2(e) when performed for non-taxable persons who are established, have their permanent address or usually reside in a Member State, by a taxable person who has established his business or has a fixed establishment from which the service is supplied outside the Community, or in the absence of such a place of business or fixed establishment, has his permanent address or usually resides outside the Community, Member States shall make use of paragraph 3(b)".

L'exportation et la réexportation hors de la Communauté de spécimens d'espèces inscrites à l'annexe A du présent règlement sont subordonnées à la réalisation des vérifications nécessaires et à la présentation préalable, au bureau de douane où sont accomplies les formalités d'exportation, d'un permis d'exportation ou d'un certificat de réexportation délivré par un organe de gestion de l'État membre où se trouvent les spécimens.

The export or re-export from the Community of specimens of the species listed in Annex A shall be subject to completion of the necessary checks and the prior presentation, at the customs office at which the export formalities are completed, of an export permit or re-export certificate issued by a management authority of the Member State in which the specimens are located.

4. L'exportation et la réexportation hors de la Communauté de spécimens d'espèces inscrites aux annexes B et C sont subordonnées à la réalisation des vérifications nécessaires et à la présentation préalable, au bureau de douane où sont accomplies les formalités d'exportation, d'un permis d'exportation ou d'un certificat de réexportation délivré par un organe de gestion de l'État membre sur le territoire duquel se trouvent les spécimens.
4. The export or re-export from the Community of specimens of the species listed in Annexes B and C shall be subject to completion of the necessary checks and the prior presentation, at the customs office at which the export formalities are completed, of an export permit or re-export certificate issued by a management authority of the Member State in whose territory the specimens are located.
