It is therefore essential to lay down rules for the designation and classification of goods and services in this Regulation and to ensure legal certainty and sound administration by requiring that the goods and services for which trade mark protection is sought are identified by the applicant with sufficient clarity and precision to enable the competent authorities and economic operators, on the basis of the application alone, to determine the extent of the protection applied for.

Aux fins du présent règlement, l’exercice comptable désigne la période visée à l’article 3, paragraphe 3, point a), du règlement délégué (UE) no 907/2014.
For the purposes of this Regulation, accounting year means the period referred to in point (a) of Article 3(3) of Delegated Regulation (EU) No 907/2014.

Le deuxième considérant du règlement no 1383/2003 désigne la protection des consommateurs comme étant un objectif du règlement et, conformément au troisième considérant, il convient de mettre en place une procédure appropriée permettant aux autorités douanières de faire respecter le plus rigoureusement possible l’interdiction d’introduire dans le territoire douanier de la communauté des marchandises portant atteinte à un droit de propriété intellectuelle sans pour autant entraver la liberté du commerce légitime visée dans le deuxième considérant de ce règlement et dans le premier considérant du règlement de mise en œuvre no 1891/2004 (2). Est-il compatible avec ces objectifs que les mesures prévues à l’article 17 du règlement no 1383/2003 ne puissent être appliquées que lorsque le titulaire du droit engage la procédure visant à déterminer s’il y a eu violation d’un droit de propriété intellectuelle, procédure visée à l’article 13, paragraphe 1, du règlement, ou bien l’autorité douanière doit-elle pouvoir elle aussi engager cette procédure afin de permettre la meilleure réalisation possible des objectifs susvisés?
Recital 2 in the preamble to Regulation No 1383/2003 mentions as one of the objectives of the regulation the protection of consumers, and according to recital 3 in the preamble a procedure should be set up to enable the customs authorities to enforce as effectively as possible the prohibition of the introduction into the Community customs territory of goods infringing an intellectual property right, without impeding the freedom of legitimate trade in accordance with recital 2 in the preamble to the regulation and recital 1 in the preamble to implementing regulation No 1891/2004 (2) Is it compatible with those objectives if the measures laid down in Article 17 of Regulation No 1383/2003 can be applied only if the right-holder initiates the procedure mentioned in Article 13(1) of the regulation for determination of an infringement of an intellectual property right, or must it also be possible, for the effective pursuit of those objectives, for the customs authorities to initiate the corresponding procedure?

For the purposes of this Regulation, the concept of "carry-over" is used specifically to designate the transfer of traces of an active substance contained in a medicated feed to a non-target feed, while the term "cross-contamination" is to be considered as a contamination resulting from a carry-over or from the transfer in feed of any unintended substance.

1.
