The European Commission requested Luxembourg, Poland and Portugal today to comply with judgements of the Court of Justice of the EU related to the good functioning of the internal market for road transport.In 3 judgements from 2016[†], the Court found these Member States to be in breach of EU law (Regulation (EC) No 1071/2009) for not having established national electronic registers of road undertakings and for not having interconnected those with the registers of the other Member States.National electronic registers of road undertaking are database which contain some information (such as the name, address and number of vehicles) on all companies that have been authorised to perform commercial operations by a Member State.

In the field of road transport, Council Regulation (EEC) No 3820/85 of 20 December 1985 on the harmonisation of certain social legislation relating to road transport sought to harmonise the conditions of competition between modes of inland transport, especially with regard to the road transport sector, and to improve working conditions and road safety.

(15) CONVIENT que le transport routier commercial requiert une attention particulière, et que la Commission devrait jouer un rôle important en vue de la poursuite du renforcement de la sécurité routière dans ce domaine, du fait de son caractère international, notamment en ce qui concerne la législation relative au temps de conduite et de repos, et de son application, sans perdre de vue la nécessité d'une concurrence équitable dans l'ensemble de la Communauté et CONFIRME sa détermination à améliorer l'efficacité et à parfaire la réglementation sur les conditions de travail, les questions techniques et autres liées à la sécurité routière.
(15) AGREES that commercial road transport requires particular attention, and that the Commission should play an important role towards further improvement of road safety in this sector, because of its international character, in particular as regards the legislation on driving and rest times and its enforcement, whilst paying attention to the need for fair competition across the Community and CONFIRMS its determination to improve the effectiveness of and to develop further regulations on working conditions, technical and other issues related to road safety.
