Conformément au règlement (CE, Euratom) no 1605/2002 du Conseil du 25 juin 2002 portant règlement financier applicable au budget général des Communautés européennes (1) et au règlement financier adopté par le conseil d'administration de l'Agence le 26 mars 2003, au règlement (CE, Euratom) no 2343/2002 de la Commission du 19 novembre 2002 portant règlement financier-cadre des organismes visés à l'article 185 du règlement (CE, Euratom) no 1605/2002 du Conseil portant règlement financier applicable au budget général des Communautés européennes (2), ainsi qu'aux autres réglementations auxquelles se réfère la présente décision, les contrats ou conventions conclus ainsi que les décisions prises avec des bénéficiaires établis en Suisse peuvent prévoir que des audits scientifiques, financiers, technologiques ou autres peuvent être effectués à tout moment auprès d'eux et de leurs sous-traitants par des agents de l'Agence et de la Commission ou par d'autres personnes mandatées par celles-ci.

In accordance with Council Regulation (EC, Euratom) No 1605/2002 of 25 June 2002 on the Financial Regulation applicable to the general budget of the European Communities (1) and the Financial Regulation adopted by the Management Board of the Agency on 26 March 2003, with Commission Regulation (EC, Euratom) No 2343/2002 of 19 November 2002 on the framework Financial Regulation for the bodies referred to in Article 185 of Council Regulation (EC, Euratom) No 1605/2002 on the Financial Regulation applicable to the general budget of the European Communities (2) and with the other instruments referred to in this Decision, contracts or agreements concluded and decisions taken with beneficiaries established in Switzerland may provide for scientific, financial, technological or other audits to be conducted at any time on the premises of the beneficiaries and of their subcontractors by Agency and Commission officials or by other persons mandated by the Agency and the Commission.

ACKNOWLEDGES the overall conclusions of the report which pointed to the complexity of the rules applicable to the Fifth Framework Programme intervention mechanisms, as well as to shortcomings in the Commission’s organisational, coordinating and management structures across five Directorates General, and insufficient human resources and support tools; WELCOMES, in the context of the preparation and implementation of the Sixth Framework Programme, the Commission’s achievements in following up and implementing the Court of Auditors’ recommendations in such areas as internal co-ordination and management instruments, ex-post control of projects, staffing and the use of information technology; RECALLS with satisfaction the expeditious manner in which the legislative Decisions on the Sixth Framework Programme were taken, in codecision with the European Parliament, which contributed to the effective launch of the programme; ACKNOWLEDGES that work is necessary to further streamline the management and the procedures applied to project proposers and promoters in the Sixth Framework Programme in order to achieve high quality participation in Community RTD programmes and to avoid unnecessary administrative burdens, while ensuring that the financial interests of the Community are safeguarded in accordance with the Financial Regulation; NOTES that:

This should be carried out in the context of the assessments and reports foreseen under Articles 4 and 6 of the Sixth Framework Programme Decision before the Commission submits its proposal for the next framework programme which should aim at simplifying the implementation process to make it more user friendly, in particular for small and medium-sized enterprises and start-ups, and in compliance with the Financial Regulation. Guarantee Fund - Own resources - Budgetary discipline - Financial Regulation Following the agreement reached by the European Parliament as part of the conciliation procedure and in accordance with the joint guidelines adopted earlier, the Council formally adopted the following Regulations and Decisions: - Regulation establishing a Guarantee Fund for external operations; - Decision on the system of the European Communities' own resources; - Decision on budgetary discipline; - Regulation (EC, Euratom) amending Regulation (EEC, Euratom) No 1552/89 implementing Decision 88/376/EEC, Euratom on the system of the Communities' own resources (entry of own resources corresponding to the reserves linked to external operations); - Regulation (ECSC, EC, Euratom) amending the Financial Regulation of 21 December 1977 applicable to the general budget of the European Communities (reserves linked to external operations).
