In terms of general context, the hon. member for Selkirk—Interlake is correct that the Standing Orders state that when members rise to speak to a matter before the House, their comments ought to be relevant to that matter.

Le requérant soutient que le Secrétaire général du Parlement européen a décidé de manière absolument infondée et illégale, par sa décision (D(2014) 15503), qu’une indemnité d’un montant de 37 728 EUR lui avait été indûment versée, et a ordonné sans fondement et illégalement au comptable du Parlement européen, en vertu de l’article 68 des mesures d’application du statut des députés au Parlement européen ainsi que de l’article 80 des règles d’application du règlement financier, de recouvrer auprès du requérant l’indemnité de 37 728 EUR et d’en informer dûment celui-ci, conformément à la procédure, par une note de débit no 2014-575.
The applicant submits that, in Decision D(2014) 15503, the Secretary-General of the European Parliament decided in an entirely unfounded and unlawful manner that the amount of EUR 37 728 had been unduly paid to the applicant and, in a manner which was unfounded and unlawful under Article 68 of the Implementing Measures for the Statute for Members of the European Parliament and Article 80 of the Rules of Application for the Financial Regulation, instructed the Accounting Officer of the European Parliament to recover from the applicant the payment of EUR 37 728 and, in accordance with the procedure laid down, to notify the applicant of that matter by Debit Note No 2014-575.

À cette fin, monsieur le Président, si la question de privilège vous paraît fondée à première vue , je suis prêt à présenter la motion que voici: Que les questions que soulève la décision rendue le 31 octobre 2014 par la Cour de justice de l'Ontario — décision qui concerne le député de Peterborough et des infractions à la Loi électorale du Canada, en particulier celle d'avoir délibérément fait des dépenses électorales dépassant le plafond permis, à l'encontre de l'article 443 de la loi — soient renvoyées au Comité permanent de la procédure et des affaires de la Chambre afin que celui-ci présente ses recommandations à la Chambre, notamment sur les points suivants: a) la suspension du député, sans traitement, jusqu'à la fin des procédures juridiques; b) l'expulsion du député, si aucune autorité n'infirme la condamnation aux termes de l'article 443 et que le député ne dispose d'aucun autre droit d'appel, auquel cas le Président adressera au directeur général des élections l'ordre officiel d'émettre un bref afin d'élire le député qui représentera la circonscription de Peterborough dans la présente législature; c) la stratégie à adopter quant aux avantages du député, notamment son régime de retraite, son allocation de dépenses de déplacement et son assurance; d) la stratégie à adopter quant aux employés du député et à la gestion de ses bureaux; et e) toute autre question découlant de cette affaire et du règlement de celle-ci.
To that end, Mr. Speaker, should you find a prima facie case of privilege, I am prepared to move this motion: That the matter of the October 31, 2014 decision of the Ontario Court of Justice respecting the member for Peterborough in relation to charges under the Canada Elections Act — and, in particular, that of wilfully incurring expenses in excess of a campaign expense limit, contrary to section 443 of the Act — be referred to the Standing Committee on Procedure and House Affairs with instruction that it report back to the House with recommendations, including those addressing the following issues: (a) a suspension of the member without pay, pending the finalization of all legal proceedings in this matter; (b) an expulsion of the member, should a conviction under section 443 not be set aside by a competent authority and no further rights of appeal remain available to the member, together with the appropriate order, in those circumstances, for the Speaker to issue his warrant to the Chief Electoral Officer for the issue of a writ for the election of a member to serve in the present Parliament for the electoral district of Peterborough; (c) the appropriate approach respecting the member's pensions, travel status expense account, insurance and other benefits; (d) the appropriate approach respecting the employment of the staff, and management of the offices, of the member; and (e) any other questions that arise as a result of this matter and its disposition.

1. Breaches of confidentiality in general, and of this Decision in particular, shall in the case of Members of the European Parliament entail the application of the relevant provisions concerning penalties set out in the European Parliament's Rules of Procedure.

3. Si le secrétaire général, en consultation avec les questeurs, acquiert la certitude que des sommes ont été indûment versées au titre des indemnités prévues par la présente réglementation en faveur des députés du Parlement européen, il donne des instructions en vue du recouvrement de ces sommes auprès du député concerné.
3. Where the Secretary-General, in consultation with the Quaestors, is satisfied that undue sums have been paid by way of allowances provided for Members of the European Parliament by these Rules, he shall give instructions for the recovery of such sums from the Member concerned.

L'article 1er du statut reprend la notion de député, en précisant qu'il ne s'agit pas de réglementer les droits et obligations de celui-ci, mais de fixer le statut et les conditions générales d'exercice de ses fonctions.

36.1(1) À la demande du député qui présente une pétition ou, si aucune demande n'est formulée au moment de la présentation de la pétition, de tout autre député qui en donne avis par écrit au Greffier, une pétition déposée conformément à l'article 36 du Règlement et dite signée par deux pour cent des personnes autorisées à voter lors de la dernière élection générale à la Chambre des communes peut être renvoyée au directeur général des élections, qui détermine dans un délai de quarante-deux jours si la pétition respecte cette exigence en comptant les signatures et en en vérifiant une proportion qui lui semble raisonnable.
36.1(1) At the request of the Member presenting a petition, or if no request is made at the time of the presentation of the petition, by any other Member giving notice in writing to the Clerk, a petition which has been presented in accordance with Standing Order 36 and which purports to be signed by two per cent of the persons entitled to vote in the last general election to the House of Commons may be referred to the Chief Electoral Officer, who shall determine within forty-two days whether the petition complies with this requirement by counting the signatures and verifying such proportion of them as is in his or her opinion reasonable.
