On the basis of a report by the committee responsible for budgetary control, the President, acting on behalf of Parliament, may bring an action before the Court of Justice of the European Union against the institution concerned, pursuant to Article 265 of the Treaty on the Functioning of the European Union, for failure to comply with the obligations deriving from the comments accompanying the discharge decision or the other resolutions concerning implementation of expenditure.

En cas de recours contre une décision de rejet prise par l’institution de l’un des États membres sous la législation desquels l’intéressé a exercé une activité susceptible de provoquer la maladie professionnelle considérée, cette institution est tenue d’en informer l’institution à laquelle la déclaration ou notification a été transmise, selon la procédure prévue à l’article 36, paragraphe 2, du règlement d’application, et de l’aviser ultérieurement lorsqu’une décision définitive intervient.

In the event of an appeal against a decision to refuse benefits taken by the institution of one of the Member States under the legislation of which the person concerned pursued an activity likely to cause the occupational disease in question, that institution shall inform the institution to which the declaration or notification was sent, in accordance with the procedure provided for in Article 36(2) of the implementing Regulation, and shall subsequently inform it when a final decision is reached.
