21. Calls on the regulator to take into account the GIs already existing in the Member States in order to avoid unnecessary red tape for their registration at European level, to ensure that the creation of a single EU level of protection for non-agricultural GIs does not lower standards of protection already afforded by, or supersede, pre-existing systems, such as trademarks, in some Member States, and to allow for national systems of GI protection to continue to coexist with a uniform EU system; calls on the regulator to propose the most efficient, simple, useful and accessible mechanism for registration of products, and to ensure that the system provides affordable, clear and transparent registration, modification and cancellation procedures, providing legal guarantees to stakeholders; calls on the Commission to carry out a thorough assessment with a view to minimising financial and administrative work for stakeholders.

(20) In order to ensure uniform conditions for the implementation of this Regulation with regard to the methods of analysis for determining the composition of aromatised wine products; decisions on conferring protection on geographical indications and on rejecting applications for such protection; decisions on cancelling the protection of geographical indications and of existing geographical designations; decisions on approval of application for amendments in the case of minor amendments to the product specifications; the information to be provided in the product specification with regard to the definition of geographical indication; the means of making decisions on protection or rejection of geographical indications available to the public; relating to the submission of trans-border applications; checks and verifications to be carried out by Member States; the procedure, including admissibility, for the examination of applications for protection or for the approval of an amendment of a geographical indication, and the procedure, including admissibility, for requests for objection, cancellation or conversion and the submission of information relating to existing geographical designations; administrative and physical checks to be carried out by Member States; and rules on providing the information necessary for the application of the provision concerning the exchange of information between Member States and the Commission, the arrangements for the management of the information to be notified , the content, form, timing, frequency and deadlines of the notifications and arrangements for transmitting or making information and documents available to the Member States, the competent authorities in third countries, or the public ; implementing power should be conferred on the Commission.

(19) In order to supplement or amend certain non-essential elements of this Regulation, the power to adopt acts in accordance with Article 290 of the TFEU should be delegated to the Commission in respect of the establishment of production processes for obtaining aromatised wine products; criteria for the demarcation of geographical areas and rules, restrictions and derogations related to production in such areas; the conditions under which a product specification may include additional requirements; the determination of the cases in which a single producer may apply for the protection of a geographical indication and the restrictions governing the type of applicant that may apply for such protection; the establishment of the conditions to be complied with in respect of an application for the protection of a geographical indication, scrutiny by the Commission, the objection procedure and procedures for amendment and cancellation of geographical indications; the establishment of the conditions applicable to trans-border applications; the setting of the date for the submission of an application or a request, the date from which the protection applies and the date on which an amendment to a protection applies; the establishment of the conditions relating to amendments to product specifications, including the conditions when an amendment is considered minor and the conditions relating to the applications for, and approval of, amendments, which do not involve any change to the single document; the restrictions regarding the protected name; the nature and type of information to be notified in the exchange of information between Member States and the Commission, the methods of notification, the rules related to the access rights to information or information systems made availableandand the modalities of publication of the information.

1. Lorsqu'une indication géographique est protégée au titre du présent règlement, l'enregistrement d'une marque commerciale dont l'utilisation relève de l'article 20, paragraphe 2, et concernant un produit vinicole aromatisé est refusé dans le cas où la demande d'enregistrement de la marque commerciale est présentée après la date de dépôt auprès de la Commission de la demande de protection de l'indication géographique et où cette demande aboutit à la protection de l'indication géographique.
Where a geographical indication is protected under this Regulation, the registration of a trademark the use of which falls under Article 20(2) and relating to an aromatised wine product shall be refused if the application for registration of the trademark is submitted after the date of submission of the application for protection of the geographical indication to the Commission and the geographical indication is subsequently protected.

Pour l'UE, l'accord prévoit de développer l'utilisation et la protection du système des indications géographiques et d'intervenir à la source en cas d'abus potentiels concernant les indications géographiques de l'UE. Pour sa part, la Moldavie verra assurés le développement et la protection de ses indications géographiques actuelles sur le territoire de l'UE et renforcera ses relations avec l'UE.
For the EU the agreement provides for expanded protection and use of the geographical indications (GIs) system and intervention at the source of potential misuses of EU GIs. In return, Moldova will develop and protect its current geographical indications in the EU territory and strengthen its relationship with the EU.

Ensuite, la Cour relève que les deux marques finlandaises, enregistrées le 31 janvier 2003, ne peuvent pas bénéficier de la dérogation prévue par le règlement autorisant l'usage d'une marque acquise avant la date de protection de l'indication géographique dans le pays d'origine (ou avant le 1 janvier 1996) même si elle porte atteinte à l'indication géographique concernée.
Next, the Court observes that the two Finnish trade marks, registered on 31 January 2003, cannot benefit from the derogation provided for under the regulation, in accordance with which the use of a mark which was acquired before the date of protection of the geographical indication in the country of origin (or before 1 January 1996) is permitted, even if it adversely affects the geographical indication concerned.

Recalls that some GIs are systematically counterfeited in third countries; this undermines the reputation and image of the GI product and misleads consumers; emphasises that securing protection of a GI in a third country is a long and difficult procedure for producers, since each third country may have developed its own specific protection system; invites the European Commission to support technically and financially the organisations in charge of GIs in order to facilitate the resolution of usurpation problems;

On 11 December 2009, the European Union and Switzerland concluded negotiations on a bilateral agreement for the protection of their respective Geographical Indications for agricultural products and foodstuffs.
