– having regard to the draft Treaty concerning the Accession of the Republic of Croatia to the European Union, the Protocol and the Final Act,

5. Les autorités compétentes n'accordent aucune autorisation pour la vente, la fourniture, le transfert ou l'exportation des technologies incluses à l'annexe II si elles ont des motifs raisonnables de croire que cette vente, cette fourniture, ce transfert ou cette exportation des technologies concerne des projets ayant trait à l'exploration et la production de pétrole en eaux profondes, à l'exploration et la production de pétrole dans l'Arctique ou à des projets dans le domaine du schiste bitumineux en Russie.
5. The competent authorities shall not grant any authorisation for any sale, supply, transfer or export of the technologies included in Annex II, if they have reasonable grounds to determine that the sale, supply, transfer or export of the technologies is for projects pertaining to deep water oil exploration and production, Arctic oil exploration and production, or shale oil projects in Russia.

12. demande à la Conférence intergouvernementale de reprendre dans une déclaration - à joindre à l'Acte final de ladite Conférence - sur l'article [9 A], paragraphe 2, du traité sur l'Union européenne, tel qu'il est repris dans le projet de traité modificatif, le projet de décision du Conseil européen fixant la composition du Parlement européen figurant à l'annexe 1 de la présente résolution, étant entendu que son adoption formelle conformément à la procédure prévue à l'article [9 A], paragraphe 2, précité, aura lieu immédiatement après l'entrée en vigueur du traité modificatif; s'engage, en ce qui le concerne, à faire diligence dès l'entrée en vigueur du traité modificatif; invite le Conseil européen à mettre en œuvre la déclaration mentionnée plus haut dès que le traité modificatif entrera en vigueur et conformément à ses dispositions, afin de permettre aux États membres de prendre les dispositions internes nécessaires en temps utile pour l'organisation des élections au Parlement européen pour la législature 2009-2014;
12. Calls on the Intergovernmental Conference to incorporate the draft decision of the European Council establishing the composition of the European Parliament, as set out in Annex 1 to this resolution, in a declaration on Article [9a](2) of the Treaty on European Union as incorporated in the draft amending treaty to be attached to the final act of the said Conference with the proviso that it will be formally adopted in accordance with the procedure laid down in the aforementioned Article [9a](2) immediately after the entry into force of the amending treaty; undertakes, for its part, to act without delay once the amending treaty has entered into force; calls on the European Council to give effect to the aforementioned declaration, as soon as the amending treaty enters into force and in accordance with its provisions, so that the Member States can enact, in good time, the necessary domestic provisions for organising the elections to the European Parliament for the 2009-2014 parliamentary term;

14. attire l'attention sur le lien politique qui existe entre la nouvelle répartition des sièges proposée sur la base du principe de proportionnalité dégressive et l'ensemble du train de réformes relatives aux institutions de l'Union, en particulier le principe de double majorité pour la détermination de la majorité au Conseil (article [9 C], paragraphe 4, du traité sur l'Union européenne tel qu'il est repris dans le projet de traité modificatif) et la composition de la Commission (article [9 D], paragraphe 5, du traité mentionné ci-dessus), et souligne combien il importe que ce train de réformes soit cohérent tout en reconnaissant dans le même temps la nature juridique spécifique de chaque institution; convient que, si la réforme du vote à la majorité au Conseil et de la composition de la Commission ne doivent entrer en vigueur qu'en 2014, la nouvelle répartition des sièges au Parlement européen devrait prendre effet dès 2009; se réserve toutefois le droit de n'envisager l'approbation de la décision du Conseil européen conformément à l'article [9 A] du traité sur l'Union européenne concernant la nouvelle répartition des sièges au Parlement européen qu'à la lumière des réformes des institutions de l'Union telles qu'elles seront formulées dans le traité modificatif;
14. Draws attention to the political connection between the proposed new distribution of seats in accordance with the principle of degressive proportionality and the overall reform package for the institutions of the Union, particularly the 'double majority' principle for the definition of a majority in the Council (Article [9c](4) of the Treaty on European Union as incorporated in the draft amending treaty) and the composition of the Commission (Article [9d](5) of the aforementioned treaty), and stresses the need for that package to be coherent while at the same time recognising the specific legal nature of each institution; agrees that, while the reform of majority voting in the Council and of the composition of the Commission should not enter into force until 2014, the new distribution of seats in the European Parliament should take effect in 2009; reserves the right, however, to assess its consent to the European Council decision pursuant to the aforementioned Article [9a] of the Treaty on European Union on the new distribution of seats in the European Parliament in the light of the reforms of the EU institutions as laid down in the amending treaty;
