3. Where the Commission finds that a performance plan, or part thereof, and some or all of its target(s) are not consistent with the Union-wide targets and are not contributing adequately to them and/or are not consistent with one or more of the criteria laid down in Annex IV, it shall, within five months after reception of the performance plan and in accordance with the procedure established in Article 5(2) of Regulation (EC) No 549/2004, issue a recommendation to the Member State(s) concerned to adopt a revised performance plan, or part thereof, and/or target(s).

Lorsque la Commission juge qu’un plan ou une partie de plan de performance révisé et certains ou l’ensemble de ses objectifs de performance ne sont toujours pas compatibles avec les objectifs à l’échelle de l’Union et n’y contribuent pas utilement, ou qu’ils ne sont toujours pas compatibles avec l’un ou plusieurs des critères définis à l’annexe IV, elle décide, dans les cinq mois suivant la réception du plan ou de la partie de plan de performance révisé et conformément à la procédure prévue à l’article 5, paragraphe 3, du règlement (CE) no 549/2004, que l’État membre ou les États membres concernés doivent prendre des mesures correctrices.
3. Where the Commission finds that a revised performance plan, or part thereof, and some or all of its performance targets are still not consistent with the Union-wide targets and are not contributing adequately to them, and/or are still not consistent with one or several of the criteria laid down in Annex IV, the Commission shall, within five months after receiving the revised performance plan, or part thereof, and in accordance with the procedure referred to in Article 5(3) of Regulation (EC) No 549/2004, decide that the Member State(s) concerned shall take corrective measures.

Afin que le PERE puisse être pris en compte pour la discipline budgétaire, il est nécessaire d’adapter les dispositions relatives au plafond budgétaire des dépenses financées par le Fonds européen agricole de garantie (FEAGA) visé à l’article 12 du règlement (CE) no 1290/2005 en prenant également en considération les sommes fixées au titre de la rubrique 2 pour le développement rural, dans le cadre du plan de relance, conformément à la décision 2009/434/CE du Conseil du 25 mai 2009 modifiant la décision 2006/493/CE déterminant le montant du soutien communautaire en faveur du développement rural pour la période allant du 1er janvier 2007 au 31 décembre 2013, sa ventilation annuelle, ainsi que le montant minimal à affecter aux régions qui peuvent bénéficier de l’objectif «convergence» , ainsi que le montant alloué aux projets dans le domaine de l’énergie qui pourrait être décidé conformément à la procédure prévue dans la déclaration du Parlement européen, du Conseil et de la Commission concernant le financement de projets dans le domaine de l’énergie et de l’internet à haut débit ainsi que de mesures liées au bilan de santé de la PAC dans le cadre du plan européen pour la relance économique .
In order to ensure that the EERP is taken into account for the budget discipline, it is necessary to adapt the provisions concerning the budget ceiling for the expenditure financed by the European Agricultural Guarantee Fund (EAGF) referred to in Article 12 of Council Regulation (EC) No 1290/2005 by taking also into account the sums fixed under Heading 2 for the rural development under the recovery package in accordance with Council Decision 2009/434/EC of 25 May 2009 amending Decision 2006/493/EC laying down the amount of Community support for rural development for the period from 1 January 2007 to 31 December 2013, its annual breakdown and the minimum amount to be concentrated in regions eligible under the Convergence Objective and the amount for projects in the field of energy which could be decided in accordance with the procedure set out in the Declaration of the European Parliament, the Council and the Commission on the financing of projects in the field of energy and broadband Internet as well as the CAP Health Check in the framework of the European Economic Recovery Plan .

La procédure prévue à l'article 8, paragraphe 2, s'applique en ce qui concerne l'approbation, sur la base du respect des priorités fixées à l'article 5, du rapport préliminaire et du plan général de réalisation de chaque projet IDA au terme de la phase de faisabilité et de la phase de mise au point et de validation ainsi que l'approbation de toute modification substantielle ultérieure apportée à ce plan de mise en oeuvre.
3. The procedure referred to in Article 8(2) shall apply in respect of the approval, on the basis of compliance with the principles laid down in Article 5, of the preparatory report and of the global implementation plan of each IDA project at the end of the feasibility phase and at the end of the development and validation phase, as well as the approval of any subsequent substantial amendments to that implementation plan.
