Par ailleurs, la directive dispose, en son article 14, paragraphe 2, que le champ de l’exonération des accises puisse être réservé aux transports aériens internationaux et intracommunautaires, ce qui par construction revient implicitement à laisser aux États membres la possibilité de taxer la consommation de carburants destinée aux vols aériens domestiques.
Furthermore, Article 14(2) of the directive allows for the scope for exemption from excise to be reserved for international and intra-Community air transport, which by design implicitly allows the Member States the possibility of taxing the consumption of fuels intended for domestic flights.
