Bearing in mind that the majority of the crew on many non-Community flagged vessels calling at European ports are Filipino, as well as the harsh and inhuman working conditions in which many of these seafarers live, calls on Member States not to allow these vessels to be received in European ports when the working conditions on board contravene the labour rights and principles enshrined in the Charter of Fundamental Rights of the European Union; urges, likewise, non-Community flagged vessels to guarantee their crews’ working conditions in accordance with international legislation and the rules laid down by the ILO and the IMO.

L'objectif principal de la proposition de la Commission était de refondre la législation existante sur le contrôle par l'État du port de manière à clarifier et renforcer ses dispositions afin d'assurer une meilleure application du régime des contrôles dans les ports et mouillages de l'Union européenne La Commission a aussi ajouté un certain nombre de dispositions nouvelles dans des domaines qui n'étaient pas couverts par le contrôle de l'État du port, comme la sûreté maritime, pour tenir compte des évolutions récentes du droit international et communautaire.
The main aim of the Commission proposal was to review existing legislation on Port State control, with a view to clarification or reinforcement of its provisions and to ensure a more effective application of the system of control in ports and anchorages in the European Union. The Commission proposal also added a number of provisions, in areas which were not covered by port State control, such as maritime safety, in order to take account of recent developments in international and Community law.
