(3) After having examined all possibilities for re-allocating appropriations under the expenditure ceilings for heading 3 (Security and Citizenship ) and heading 4 (Global Europe ), it appears necessary to mobilise the Flexibility Instrument to complement the financing in the general budget of the European Union for the financial year 2016, beyond the ceilings of heading 3 by EUR 1 506 million and heading 4 by EUR 24 million to finance measures in the field of migration and refugees.

Notes that heading 5 will be under considerable pressure in 2005 due, among other things, to the effects that the new gross national income estimates will have on the technical adjustment of the Financial Perspective and the resulting reduction of the ceiling; recalls that all the Secretaries General of the institutions presented an estimation of needs in 2005 in the third report on the evolution of heading 5; points out that the estimation provided is no longer compatible with the adjusted ceiling of the Financial Perspective in 2005; urges all institutions, therefore, to fine-tune and scale down their needs when they present their 2005 estimates of expenditure, so that the ceiling of heading 5 is not exceeded, as is also outlined in the attached declaration on heading 5;

Underlines the fact that pressure on the ceiling for heading 5, due to the constraints of the current financial perspective, will be highest in 2003; therefore, welcomes the fact that Parliament and the Council have agreed on a common approach concerning the broad aspects of heading 5 and that a joint statement was adopted at the conciliation meeting of 19 July 2002 in which both sides undertook to observe the existing ceiling for heading 5, not to use the flexibility instrument for this heading, to endeavour to finance the publication of the "acquis communautaire" and other pressing needs in the Commission by means of a frontloading operation and to transfer EUR 29 million entered in specific reserves for the "acquis" to the Commission;

Underlines the fact that, on the one hand, the ceiling of heading 5 has been under constant pressure over the previous years due to the integration of new activities; notes, on the other hand, that the financing of some new activities has been simply shifted from heading 5 to other headings due to a lack of margin under the ceiling in heading 5, a trend which creates budgetary and institutional problems; welcomes the Council's willingness, as expressed at the end of the budgetary procedure for the 2002 financial year, to examine these problems together with Parliament well in advance of enlargement and to follow up the report submitted by the Secretaries-General of the institutions on the evolution of heading 5 and to launch a discussion at the appropriate political level in spring 2002; invites Council to examine thoroughly, together with Parliament, all possibilities that interinstitutional cooperation can offer and reach the necessary conclusions within the 2003 budgetary procedure, whereas the specific needs of each institution and their institutional independence should be taken into consideration;
