The EU therefore acquires legal personality, enabling it to negotiate and to be a contracting party in international Treaties.

2. À moins que le traité n'en dispose autrement ou que les États ayant participé à la négociation n'en soient convenus autrement, l'application à titre provisoire d'un traité ou d'une partie d'un traité à l'égard d'un État prend fin si cet État notifie aux autres États entre lesquels le traité est appliqué provisoirement son intention de ne pas devenir partie au traité.
2. Unless the treaty otherwise provides or the negotiating States have otherwise agreed, the provisional application of a treaty or a part of a treaty with respect to a State shall be terminated if that State notifies the other States between which the treaty is being applied provisionally of its intention not to become a party to the treaty.

8. Les États membres et la Communauté encouragent les organes compétents qui relèvent du traité instituant la Communauté de l’énergie à prendre, conformément aux dispositions de ce traité, les mesures nécessaires pour que les parties contractantes audit traité puissent appliquer les dispositions en matière de coopération entre États membres fixées dans la présente directive.
8. Member States and the Community shall encourage the relevant bodies of the Energy Community Treaty to take, in conformity with the Energy Community Treaty, the measures which are necessary so that the Contracting Parties to that Treaty can apply the provisions on cooperation laid down in this Directive between Member States.

This should result in a termination of the provisional application of the agreement: Article 25(2) of the Vienna Convention on the Law of Treaties holds that "Unless the treaty otherwise provides or the negotiating States have otherwise agreed, the provisional application of a treaty or a part of a treaty with respect to a State shall be terminated if that State notifies the other States between which the treaty is being applied provisionally of its intention not to become a party to the treaty".

4. La présente convention n’affecte pas l’application par un État contractant d’un traité, que ce traité ait été conclu avant ou après cette convention, afin d’obtenir la reconnaissance ou l’exécution d’un jugement rendu par un tribunal d’un État contractant qui est également partie à ce traité.
4. This Convention shall not affect the application by a Contracting State of a treaty, whether concluded before or after this Convention, for the purposes of obtaining recognition or enforcement of a judgment given by a court of a Contracting State that is also a Party to that treaty.

Certes, à l’instant, la Commission vient de nous redire qu’elle ne fait qu’appliquer le traité et, j’en donne acte à M. Monti, c’est vrai. Le traité lui-même pose un problème, car sa rédaction remonte pour la partie "concurrence" au traité de Rome.

On the contrary, thanks to the Irish vote, it is now possible, as Philippe de Villiers has proposed, to proceed with enlargement without confiscating national sovereignties. This can be done on the one hand by abandoning the supranational part of the treaty and including its annexed provisions on enlargement in future accession treaties, and on the other hand by enabling the candidate countries to join the European Union immediately, without the need for a supplementary treaty, by offering them accession to the intergovernmental part of the treaty as it stands.

Par ailleurs, j'ai bien noté que votre rapporteur proposait, pour sa part, une autre formule qui consisterait, si j’ai bien compris, à distinguer, d'une part, les dispositions qui feraient partie d'un traité cadre et, d'autre part, les autres dispositions, notamment les politiques communes qui feraient partie d'un protocole annexé.
In any case, I noted that your rapporteur was actually proposing an alternative solution which would involve, if I understand correctly, making a distinction between, firstly, the provisions that would be part of a framework treaty and, secondly, the other provisions, particularly the common policies, which would form part of a protocol to be appended.
