TRADUCTIONS EN CONTEXTE

Un DCT devrait être autorisé à suivre l’exécution d’une opération de rachat d’office concernant des instructions de règlement multiples, portant sur les mêmes instruments financiers et dont le délai de prolongation expire à la même date afin de réduire au minimum le nombre d’opérations de rachat d’office, dans une mesure compatible avec les exigences du présent règlement.
CSDs should be allowed to monitor the execution of a buy-in with respect to multiple settlement instructions on the same financial instruments and with the same date of expiry of the extension period with the aim of minimising the number of buy-ins to the extent compatible with the requirements of this Regulation.

6. Sans préjudice du mécanisme de sanctions visé au paragraphe 2, lorsque le prix des actions convenu lors de la négociation est supérieur au prix payé pour l’exécution de l’opération de rachat d’office, le participant défaillant paie la différence au participant destinataire au plus tard le deuxième jour ouvrable après la livraison des instruments financiers à la suite de l’opération de rachat d’office.
6. Without prejudice to the penalty mechanism referred to in paragraph 2, where the price of the shares agreed at the time of the trade is higher than the price paid for the execution of the buy-in, the corresponding difference shall be paid to the receiving participant by the failing participant no later than on the second business day after the financial instruments have been delivered following the buy-in.

7. Si l’opération de rachat d’office échoue ou n’est pas possible, le participant destinataire peut, au choix, demander qu’une indemnité financière lui soit payée ou que l’exécution de l’opération de rachat d’office soit reportée à une date ultérieure appropriée (ci-après dénommé «délai de report»).
7. If the buy-in fails or is not possible, the receiving participant can choose to be paid cash compensation or to defer the execution of the buy-in to an appropriate later date (‘deferral period’).
