First of all, the Commission considers that the contract being awarded is to be qualified as a public works contract and not as a public works concession. As a consequence, the award of a public contract through a procedure, such as that of "project financing", aimed at the award of a works concession constitutes a violation of Directive 93/37/EEC. In addition, the Commission considers that the modification of the conditions for the award of the public contract in question after the publication of the tender notice, in particular with respect to the classification of the works to be realised, amounts to a breach of EC Treaty principles, and in particular the principles of transparency and non-discrimination, in so far as it has not allowed all operators, interested in and qualified for the works resulting from the modified project, to take part in the tendering procedure.

7. Un «accord-cadre» est un accord relatif à des fournitures, ou à des services, ou à des travaux se limitant à la maintenance, conclu entre plusieurs opérateurs économiques et un pouvoir adjudicateur, par lequel ce dernier, après avoir suivi les procédures prévues par la présente directive dans toutes les phases à l’exclusion de celle relative à l’attribution, choisit les parties à cet accord sur la base des offres qu’elles lui ont soumises sur la base de critères objectifs, tels que la qualité, la quantité, la valeur technique, les délais de livraison ou d’exécution et les prix; par cet accord les opérateurs économiques s’engagent sur certains termes, fixés par le pouvoir adjudicateurs, des marchés qui seront passés en application de l’accord.
A "framework agreement" means an agreement relating to supplies, services or works concerning maintenance only between several economic operators and a contracting authority under which the contracting authority, after following the procedures laid down by this Directive up to the award phase, selects the parties to the agreement on the basis of the tenders they have submitted on the basis of objective criteria, such as quality, quantity, technical merit, delivery period or period of completion and price; under this agreement the economic operators undertake, under certain terms laid down by the contracting authority, to fulfil contracts awarded under the agreement.
