42 (1) The person who, immediately before the day on which section 48 of the new Act comes into force, held the office of secretary of the former Board is deemed to have been appointed to the office of Executive Director of the new Board, without prejudice to any salary and benefits he or she may receive by virtue of having held that office before that day.

The Commission should clarify the application of this exemption when adopting the provisions necessary for implementing this Regulation, as provided for in Article 7, in order to truly ease the reporting burden for persons or bodies who are subject to the obligations flowing from this Regulation and those who are responsible for administering the reporting system in the Member States.

1. In the procedures for awarding contracts, the contracting authority must state in the contract documents, or be obliged by a Member State to do so, the authority or authorities and organisations from which a tenderer may obtain the appropriate information on the obligations deriving from the rules on collective agreements and other labour and social regulations and legislation, as well as from tax and environmental regulations, which are in force in the Member State, region or locality in which the services are to be provided or in which the works are to be performed and which shall be applicable to the services provided or the works carried out on site during the performance of the contract.
