7. Expresses its concern at the imminent adoption of the draft Foreign NGO Management Law, given that in its current state it would drastically hamper the activities of Chinese civil society and would severely restrict the freedoms of association and expression in the country, including by banning overseas NGOs that are not registered with the Chinese Ministry of Public Security and prohibiting provincial public security departments from funding any Chinese individual or organisation, and Chinese groups from conducting ‘activities’ on behalf of, or with the authorisation of, non-registered overseas NGOs, including those based in Hong Kong and Macao; calls on the Chinese authorities to substantially revise this draft law in order to bring it into line with international human rights standards, including international commitments made by the People’s Republic of China;

I. whereas it is expected that the country will lose USD 600-700 million in development projects annually once the law has been passed; whereas LANGO would place restrictions on budgets, which would threaten the capacity of international NGOs to run cost-effective projects;

E. considérant que plusieurs ONG de renom ont insisté sur le fait que ce projet de loi fait suite à d'autres tentatives, retirées du fait de l'opposition qu'elles suscitaient au niveau national et international, visant à adopter une loi qui imposerait des restrictions injustifiées à la liberté d'association et d'expression et à instituer des bases juridiques justifiant la fermeture ou le refus d'autoriser la création d'ONG dissidentes, y compris d'ONG employant des défenseurs des droits de l'homme;
E. whereas several renowned NGOs have pointed out that LANGO follows previous attempts, later withdrawn in response to domestic and international opposition, to enact a law that would impose unwarranted restrictions on the rights to freedom of association and expression and create legal grounds for arbitrarily closing or denying registration to politically disfavoured NGOs, including those employing human rights defenders;

J. considérant que le projet de loi relative aux syndicats enfreindrait le droit de s'organiser et limiterait de manière draconienne les droits des syndicats indépendants, y compris des syndicats existants; considérant que le projet de loi fixe un seuil minimum excessivement élevé pour le nombre de travailleurs à réunir pour créer un syndicat (20 %); considérant que le projet de loi confère des pouvoirs très étendus au ministère du travail concernant l'autorisation des grèves et la suspension de l'inscription d'un syndicat pour des motifs inconsistants et sans procès équitable; considérant que le projet de loi interdit aux employés domestiques de se syndiquer, soumet les responsables syndicaux à des conditions d'alphabétisation qui écartent d'emblée les femmes et les étrangers, interdit tout contact avec des ONG et prévoit des amendes si basses qu'elles en sont inefficaces pour les employeurs en infraction avec le droit du travail;
J. whereas the draft law governing trade unions would violate the right to organise and would severely limit the rights of independent trade unions, including existing unions; whereas the draft law sets an unreasonably high minimum threshold for the number of workers who must join before a union can be formed (20 %); whereas the draft law gives sweeping powers to Labour Ministry officials as regards the approval of strikes and the suspension of union registration on flimsy grounds and without due process; whereas the draft law excludes domestic workers from the right to unionise, makes union leaders subject to literacy requirements which discriminate against women and non-nationals, prohibits contacts with NGOs, and sets ineffectively low fines for employers who violate labour law;

3. constate que dans le domaine d'EuropeAid, 1 153 ONG (57 % de l'ensemble des ONG) et, dans le domaine de l'aide humanitaire (ECHO), 152 ONG (8 %), agissent et reçoivent respectivement 1 520 000 000 EUR et 960 000 000 EUR de fonds de l'Union; constate que le montant des fonds de l'Union attribués à des ONG a doublé en dix ans; demande à la Commission un récapitulatif des 30 plus gros et des 30 plus petits projets que les ONG mènent à l'aide de fonds du FED, ainsi qu'un récapitulatif du montant de fonds propres des ONG qui ont été investis respectivement dans ces projets;
3. Observes that 1 153 nongovernmental organisations (57 % of all NGOs) are operating in the field of EuropeAid and 152 (8 %) in the field of humanitarian aid (ECHO), receiving EUR 1 520 million and EUR 960 million respectively in Union funding; notes that Union funding of NGOs has doubled in 10 years; calls on the Commission to provide an overview of the 30 largest and 30 smallest projects being implemented by NGOs using EDF funding, and an overview of how much of their own funding the organisations have invested in each of these projects;

La plupart des projets releve cependant de plusieurs secteurs a la fois refletant ainsi l'approche integree qui demeure caracteristique des operations ONG. 3. Le travail de sensibilisation de l'opinion publique europeenne a l'interdependance Nord-Sud, particulierement dans les domaines agricole et industriel, s'est concretise dans ces dix annees par le cofinancement de 275 projets (11,0 MECU) realises avec 132 ONG.
