Cette exclusion s’explique par le fait que la reconnaissance et l’exécution des accords d’arbitrage et des sentences arbitrales sont régies par la convention de New York de 1958, à laquelle tous les États membres sont parties.

Le projet de loi fera en sorte que les entreprises fédérales qui exercent leurs activités dans la province de Québec suivent certaines exigences. En voici quelques-unes: les entreprises devront utiliser le français dans leurs communications écrites avec le gouvernement du Québec et avec les personnes morales établies au Québec; elles donneront à leurs employés le droit d'exercer leurs activités en français; elle rédigeront en français les communications qu'elles adressent à leurs employés; elles rédigeront en français les offres d'emploi et les publieront dans un quotidien simultanément avec les offres d'emploi publiées dans une autre langue, et ce, dans une présentation au moins équivalente; elles rédigeront en français les conventions collectives et leurs annexes; enfin, toute sentence arbitrale à la suite de l'arbitrage d'un grief ou d'un différend relatif à la négociation, au renouvellement ou à la révision d'une convention collective sera, à la demande d'une partie, traduite en français ou en anglais, selon le cas, et ce, aux frais des parties.
The bill provides that federal businesses carrying on activities in Quebec will be subject to certain requirements, including the following: using French in their written communications with the Government of Quebec and with corporations established in Quebec; giving their employees the right to carry on their activities in French; drawing up communications to their employees in French; preparing offers of employment in French and publishing them in a daily newspaper at the same time, and with at least equal prominence as any offers published in a daily newspaper in a language other than French; preparing collective agreements and their schedules in French; and finally, ensuring that arbitration awards made following arbitration of a grievance or dispute regarding the negotiation, renewal or review of a collective agreement shall, at the request of one of the parties, be translated into English or French, as the case may be, at the parties' expense.

6. Toute controverse qui pourrait surgir entre les parties au différend au sujet de l'interprétation ou de l'exécution de la sentence arbitrale pourra être portée par l'une des parties devant le tribunal arbitral qui a rendu la sentence pour être jugée par lui.
6. Any controversy which may arise between the parties to the dispute as regards the interpretation and execution of the award may be submitted by any of the parties for judgement to the arbitration tribunal which made the award.
