IN-CONTEXT TRANSLATIONS

1. Pour veiller à ce que les montants destinés à financer les dépenses de marché et des paiements directs dans le cadre de la PAC, figurant actuellement à la rubrique 2 de l'annexe I de l'accord interinstitutionnel entre le Parlement européen, le Conseil et la Commission sur la discipline budgétaire et la bonne gestion financière , respectent les plafonds annuels fixés par la décision 2002/929/CE des représentants des gouvernements des États membres, réunis au sein du Conseil le 18 novembre 2002, concernant les conclusions du Conseil européen réuni à Bruxelles les 24 et 25 octobre 2002 , un ajustement des paiements directs est décidé lorsque, pour un exercice donné, les prévisions de financement desdits paiements au titre de la rubrique 2, augmentées des montants fixés aux articles 134 et 135 du présent règlement et avant application de la modulation prévue aux articles 7 et 10 du présent règlement ainsi qu'à l'article 1er, paragraphe 1, du règlement (CE) no 378/2007, indiquent que le plafond annuel susmentionné applicable sera dépassé, compte tenu d'une marge de 300 millions EUR en dessous de ce plafond.

With a view to ensuring that the amounts for the financing of the market related expenditure and direct payments of the CAP currently under heading 2 of Annex I to the Interinstitutional Agreement between the European Parliament, the Council and the Commission on budgetary discipline and sound financial management respect the annual ceilings set out in the Decision 2002/929/EC of the Representatives of the Governments of the Member States, meeting within the Council of 18 November 2002, concerning the Conclusions of the European Council meeting in Brussels on 24 and 25 October 2002 , an adjustment of the direct payments shall be determined when the forecasts for the financing of the aforementioned measures under heading 2 for a given financial year, increased by the amounts given in Articles 134 and 135 of this Regulation and before application of modulation provided for in Articles 7 and 10 of this Regulation and Article 1(1) of Regulation (EC) No 378/2007, indicate that the applicable abovementioned annual ceiling, taking into account a margin of EUR 300 000 000 below that ceiling, will be exceeded.

32 (1) Il ne peut être passé de marché ou autre entente prévoyant un paiement, dans le cadre d’un programme auquel est affecté un crédit ou un poste figurant dans les prévisions de dépenses alors déposées devant la Chambre des communes et sur lequel le paiement sera imputé, que si le solde disponible non grevé du crédit ou du poste est suffisant pour l’acquittement de toutes les dettes contractées à cette occasion pendant l’exercice au cours duquel a lieu la passation.

S'il s'avère à la fin de l'exercice budgétaire que le total des ressources propres est inférieur ou supérieur aux prévisions, ceci donne lieu à des soldes budgétaires positifs ou négatifs qui devront être inscrits lors d'exercices suivants (entre 1988 et 1992 il y a eu à plusieurs reprises des soldes positifs sans que ce "supplément" ait été dépensé). Le problème que pose cette situation c'est qu'elle conduit à une incertitude sur l'enveloppe financière disponible chaque année pour de nouveaux engagements puisqu'il charge le budget de tout le poids du passé, surtout en cas de soldes négatifs.
If, at the end of the financial year, total own resources turn out to be lower or higher than the estimates, a positive or negative balance will have to be entered in the budget for the following year (between 1988 and 1992 the budget repeatedly showed a positive balance; the surplus was not, however, spent. The problem with this is that it generates uncertainty about the total funds available each year for new commitments since it burdens the budget with all the cost of the past, especially when the balance is negative. This uncertainty runs counter to the objective of predictability, which is the very justification for the medium-term financial framework (Delors II package).
