1. Le présent règlement met en œuvre la coopération renforcée dans le domaine de la création d'une protection par brevet unitaire autorisée par la décision 2011/167/UE du Conseil, en ce qui concerne les modalités applicables en matière de traduction.
1. This Regulation implements the enhanced cooperation in the area of the creation of unitary patent protection authorised by Council Decision No 2011/167/EU with regard to the applicable translation arrangements.

Les dispositions de la CBE, l’accord relatif à une juridiction unifiée du brevet, y compris ses dispositions définissant la portée de ce droit et ses limitations, et le droit national, notamment les règles de droit international privé, devraient s’appliquer aux matières non couvertes par le présent règlement ou par le règlement (UE) no 1260/2012 du Conseil du 17 décembre 2012 mettant en œuvre la coopération renforcée dans le domaine de la création d’une protection unitaire conférée par un brevet, en ce qui concerne les modalités applicables en matière de traduction (3).
In matters not covered by this Regulation or by Council Regulation (EU) No 1260/2012 of 17 December 2012 implementing enhanced cooperation in the area of unitary patent protection with regard to the applicable translation arrangements (3), the provisions of the EPC, the Agreement on a Unified Patent Court, including its provisions defining the scope of that right and its limitations, and national law, including rules of private international law, should apply.

C. considérant que le 13 avril 2011, sur la base de la décision d'autorisation du Conseil, la Commission a adopté une proposition de règlement du Parlement européen et du Conseil mettant en œuvre la coopération renforcée dans le domaine de la création d’une protection par brevet unitaire et une proposition de règlement du Conseil mettant en œuvre la coopération renforcée dans le domaine de la création d’une protection par brevet unitaire, en ce qui concerne les modalités applicables en matière de traduction;
C. whereas on 13 April 2011, on the basis of the Council’s authorising Decision, the Commission adopted a proposal for a Regulation of the European Parliament and the Council implementing enhanced cooperation in the area of the creation of unitary patent protection, and a proposal for a Council Regulation implementing enhanced cooperation in the area of the creation of unitary patent protection with regard to the applicable translation arrangements;

– vu la proposition de règlement du Conseil mettant en œuvre la coopération renforcée dans le domaine de la création d’une protection par brevet unitaire, en ce qui concerne les modalités applicables en matière de traduction (COM(2011)216 final),
– having regard to the proposal for a Council Regulation implementing enhanced cooperation in the area of the creation of unitary patent protection with regard to the applicable translation arrangements (COM(2011)0216),

(21) Il y a lieu de compléter le présent règlement par le règlement ./. du Conseil mettant en œuvre la coopération renforcée dans le domaine de la création d'une protection par brevet unitaire, en ce qui concerne les modalités applicables en matière de traduction, adopté par le Conseil conformément à l'article 118, paragraphe 2, du TFUE.
(21) This Regulation should be complemented by Council Regulation ./.implementing enhanced cooperation in the area of the creation of unitary patent protection with regard to the applicable translation arrangements, adopted by the Council in accordance with Article 118(2) of the TFEU.
