Hormis les cas où le passager propriétaire de l'équipement a déjà été indemnisé au titre du règlement du Parlement européen et du Conseil du .relatif à la responsabilité des entreprises assurant le transport de personnes par mer ou par voie de navigation intérieure en cas d’accident , en cas de perte ou de détérioration d'un fauteuil roulant ou autre équipement de mobilité ou pièces d’un tel équipement lors de la prise en charge au port ou durant le transport à bord du navire, avant, pendant ou après le voyage, le passager propriétaire de l'équipement est indemnisé en fonction de la personne sous la responsabilité de laquelle l’équipement se trouvait au moment de la perte ou de la détérioration.
1. Unless the passenger to whom the equipment belongs has already been compensated under the Regulation of the European Parliament and of the Council of .on the liability of carriers of passengers by sea and inland waterway in the event of accidents, where wheelchairs or other mobility equipment or parts thereof are lost or damaged whilst being handled at the port or transported on board ship, before, during and after the journey, the passenger to whom the equipment belongs shall be compensated, depending on who was responsible for the equipment at the time of loss or damage.
