Recalling that the Chicago Convention recognises expressly the right of each Contracting Party to apply on a non-discriminatory basis its own air laws and regulations to the aircraft of all States, the Member States of the European Community and fifteen other European States placed a reservation on this resolution and reserved the right under the Chicago Convention to enact and apply market-based measures on a non-discriminatory basis to all aircraft operators of all States providing services to, from or within their territory.

8. Sans préjudice de la nécessité de prendre des mesures immédiates afin d'assurer la sûreté du transport aérien, les parties affirment que, lors de l'examen de mesures envisagées en matière de sûreté, chaque partie en évalue les effets négatifs possibles sur les services aériens internationaux et, à moins d'y être obligée par la loi, prend en compte ces facteurs pour déterminer quelles mesures sont nécessaires et appropriées en vue de répondre aux préoccupations liées à la sûreté.
8. Without prejudice to the need to take immediate action in order to protect transportation security, the Parties affirm that when considering security measures, a Party shall evaluate possible adverse effects on international air transportation and, unless constrained by law, shall take such factors into account when it determines what measures are necessary and appropriate to address those security concerns.
