Welcomes the holding of free elections in Myanmar/Burma on 8 November 2015, which constituted a major step towards the establishment of democracy in the country; remains concerned, however, about the constitutional framework for those elections, which reserved 25% of seats in Parliament for military personnel; acknowledges the progress made to date with regard to human rights, while stressing a certain number of shortcomings which remain, particularly as regards the rights of minorities and freedom of expression, association and peaceful assembly; condemns the discrimination against the Rohingya, which is exacerbated by the fact that that community has no legal status, and by the upsurge in hate speech against non-Buddhists; calls for in-depth, transparent and independent inquiries into all the allegations of human rights violations against the Rohingya, and considers that the four laws adopted by the Parliament in 2015 for the purpose of 'protecting race and religion' incorporate discriminatory aspects, particularly regarding gender; reiterates its call for the Office of the HCHR to be authorised to establish a representation in the country;

Mr. Speaker, I rise on a point of order to seek the unanimous consent of the House for the following motion: “That notwithstanding any standing order or usual practice of the House, clauses 210 to 218 related to the Judges Act be removed from Bill C-45, A second Act to implement certain provisions of the budget tabled in Parliament on March 29, 2012 and other measures, and do compose Bill C-47; that Bill C-47 be entitled an Act to amend the Judges Act; that Bill C-47 be deemed read a first time and be printed; that the order for second reading of said bill provide for the referral to the Standing Committee on Justice and Human Rights; that Bill C-45 retain the status on the order paper that it had prior to the adoption of this order; that Bill C-45 be reprinted, as amended; and that the law clerk and parliamentary counsel be authorized to make any technical changes or corrections as may be necessary to give effect to this motion”.

In light of Bill C-31 and the 20 additional judges, it is clear that, in terms of judicial appointments, we must ensure that certain elements are present and that there is respect, in order for the judiciary to be highly regarded by Canadians.

- La seconde consiste à prévoir un délai de prescription de cinq ans pour le recouvrement des créances communautaires -ce délai pouvant éventuellement être prolongé en cas de poursuites actives en vue du recouvrement: à l'heure actuelle, il n'y pas de délai général de prescription "communautaire" ( il y a un délai dans certains règlements sectoriels, par exemple en ce qui concerne le statut: 5 ans, le règlement PIF, protection des intérêts financiers: 4 ans, mais il y a interférence avec les droits nationaux applicables, car le contrat fait référence à ce droit national ou parce que le juge saisi est un juge national qui applique sa propre loi comme loi de procédure. Ceci aboutit à une cacophonie épouvantable dans certains États membres où la créance des institutions est prescrite après 3 ou 10 ans, ou encore l'on est simplement maintenue dans l'ignorance quant à savoir si la créance est prescrite, avant d'en saisir le juge. On ne sait pas non plus si après la prescription on peut encore compenser ou accepter un paiement spontané du débiteur. Bref, la proposition introduit de la sécurité pour les institutions et pour les débiteurs.
- The second proposal is that there should be a five-year time-bar on the recovery of sums owed to the Community. This limit could be extended in cases where active steps are being taken to secure recovery. As things stand, there is no general time-limit of a ‘Community’ nature (such a limit exists in certain sectoral regulations e.g. those concerning the Staff Regulations: 5 years, the regulation on the protection of the communities’ financial interests: 4 years). However, there is interference with the national legislation, where the contract refers to national law or where the judge is a national one applying his own law as the law of procedure. This could give rise to total chaos in those Member States where institutions’ right to collect debts is time-barred (after 3 or 10 years), or where, quite simply, no information is given on whether the deadline has lapsed until the case comes before the judge. Nor is it clear whether after the period has elapsed it is possible to accept compensation or spontaneous payment by the debtor. In brief, this proposal would introduce legal certainty for both the institutions and the debtors.

Enfin, et j'aborderai cet aspect plus en détail un peu plus tard, le projet de loi confère aux juges de la Cour canadienne de l'impôt le statut de juges de la Cour supérieure.
Finally, and I will come back to this in more detail, the bill confers superior court status on the judges of the Tax Court in Canada.
