4.1 The EESC believes that the law applicable to married couples should be determined when the marriage is contracted in order to avoid a choice of law that has no legal connection with the marriage. 2.11 In view of the distinctive characteristics of marriages, registered partnerships, and the different legal consequences which these two types of union might have, the EESC agrees that there is a need for two separate legal instruments, i.e. one on jurisdiction, applicable law and the recognition and enforcement of decisions in matters of matrimonial property regimes, and another on jurisdiction, applicable law and the recognition and enforcement of decisions regarding the property consequences of registered partnerships.
