Government Response, dated October 2, 2012, to the third report of Standing Senate Committee on Official Languages entitled: Air Canada's Obligations under the Official Languages Act: Towards Substantive Equality, tabled in the Senate on March 13, 2012.—Sessional Paper No. 1/41-1240S (Pursuant to Rule 12-24(4), the report and the response were deemed referred to the Standing Senate Committee on Official Languages)

Le fait pour une partie d'accepter des significations ou des notifications par des moyens électroniques s’entend sans préjudice de son droit de refuser d'accepter un acte qui n'est pas rédigé, ou accompagné d'une traduction, dans la langue officielle de l'État membre dans lequel elle a son domicile ou sa résidence habituelle ou, si ledit État membre a plusieurs langues officielles, dans la langue officielle ou dans l'une des langues officielles du lieu où cette partie a son domicile ou sa résidence habituelle, ou dans une langue qu'elle comprend.
The acceptance by a party of service by electronic means is without prejudice to his right to refuse to accept a document that is not written in, or accompanied by a translation into, the official language of the Member State in which he is domiciled or habitually resident or, if there are several official languages in that Member State, the official language or one of the official languages of the place where that party is domiciled or habitually resident, or in a language which he understands.

Les changements apportés à la partie VII de la Loi sur les langues officielles, en 2005, obligent le gouvernement à prendre des mesures positives pour assurer la mise en œuvre des droits linguistiques et favoriser l'épanouissement des communautés de langues officielles.
Changes to Part VII of the Official Languages Act in 2005 required the government to take positive steps to ensure the implementation of language rights and support the development of official language communities.

La partie défenderesse prétend qu’on ne saurait trouver dans la partie VII de la Loi sur les langues officielles une obligation pour le gouvernement fédéral de toujours prendre les mesures favorisant le plus l’épanouissement et le développement des communautés minoritaires ou promouvant le mieux les deux langues officielles, ou une obligation de procéder systématiquement à des consultations publiques.
The respondent contends that nowhere in part VII of the Official Languages Act is there any duty imposed on the federal government to always take those measures that most enhance the vitality and support the development of minority communities or best advance both official languages, or any duty to systematically hold public consultations.
