In order to facilitate the application of this Regulation, Member States should, with a view to making the information available to the public through the European e-Justice Portal, communicate to the Commission the language or languages they can accept for the presentation of public documents issued by the authorities of another Member State; an indicative list of public documents falling within the scope of this Regulation; the list of public documents to which multilingual standard forms can be attached as a suitable translation aid; the lists of persons qualified, in accordance with national law, to carry out certified translations, where such lists exist; an indicative list of the types of authorities empowered by national law to make certified copies; information relating to the means by which certified translations and certified copies can be identified; and information about the specific features of certified copies.

3. Where the technical information referred to in paragraph 1 is adopted by the Commission in accordance with paragraph 2, insurance and reinsurance undertakings shall use that technical information in calculating the best estimate in accordance with Article 77, the matching adjustment in accordance with Article 77c, and the volatility adjustment in accordance with Article 77d.

(50) The power to adopt acts in accordance with Article 290 of the Treaty on the Functioning of the European Union and the power to endorse regulatory technical standards in accordance with Articles 10 to 14 of Regulation (EU) No 1095/2010 should be delegated to the Commission in respect of the details to be included in the notification to ESMA and in the register and the criteria for the decision of ESMA on the eligibility for the clearing obligation, on the information and clearing threshold, on the maximum time lag regarding the contract, on liquidity, on the minimum content of governance rules, on details of record keeping, on minimum content of business continuity plan and the services guaranteed, on percentages and time horizon for margin requirements, on extreme market conditions, on highly liquid collateral and haircuts, on highly liquid financial instruments and concentration limits, on details for performance of tests, on details concerning the application of a trade repository for registration with ESMA, on fines and on details concerning the information that a trade repository should make available, as referred to in this Regulation.

(50) La Commission devrait être en mesure d’adopter, conformément à l’article 290 du traité, des actes délégués et, conformément aux articles 10 à 14 du règlement (UE) n° 1095/2010, des normes techniques réglementaires relatifs aux informations à inclure dans la notification à l’AEMF et dans le registre, et relatifs aux critères de décision de l’AEMF concernant: l’éligibilité à l’obligation de compensation centrale; les seuils d’information et de compensation; le délai maximal de confirmation du contrat; la liquidité; le contenu minimal des règles de gouvernance; les modalités de conservation des informations; le contenu minimal du plan de continuité des activités et les services garantis; les pourcentages et échéances applicables aux marges; les conditions de marché extrêmes; les garanties très liquides et les décotes; les modalités de conduite des tests; les informations à inclure dans une demande d’enregistrement présentée par un référentiel central à l’AEMF; les amendes et les informations qu’un référentiel central doit rendre disponibles; conformément au présent règlement.
(50) The Commission should be empowered to adopt delegated acts in accordance with Article 290 of the Treaty as well as regulatory technical standards in accordance with Articles 10 to 14 of Regulation (EU) No 1095/2010 in respect of the details to be included in the notification to ESMA and in the register and the criteria for the decision of ESMA on the eligibility for the clearing obligation, on the information and clearing threshold, on the maximum time lag regarding the contract, on liquidity, on the minimum content of governance rules, on details of record keeping, on minimum content of business continuity plan and the services guaranteed, on percentages and time horizon for margin requirements, on extreme market conditions, on highly liquid collateral and haircuts, on highly liquid financial instruments and concentration limits, on details for performance of tests, on details concerning the application of a trade repository for registration with ESMA, on fines and on details concerning the information that a trade repository should make available, as referred to in this Regulation.

3. Jusqu'à l'expiration du délai visé au paragraphe 7, les autorités centrales des États membres qui n'ont pas procédé à la notification visée au paragraphe 6 transmettent toutes les informations conformément à l'article 4, les demandes conformément à l'article 6, les réponses conformément à l'article 7 et les autres informations pertinentes par tout moyen permettant de laisser une trace écrite et dans des conditions permettant à l'autorité centrale de l'État membre qui les reçoit d'en établir l'authenticité.
3. Until the time limit set out in paragraph 7 has elapsed, central authorities of Member States which have not carried out the notification referred to in paragraph 6 shall transmit all information in accordance with Article 4, requests in accordance with Article 6, replies in accordance with Article 7 and other relevant information by any means capable of producing a written record under conditions allowing the central authority of the receiving Member State to establish the authenticity thereof.

2. Third country issuers are not subject to a requirement, under Annex I, item 20.1; Annex IV, item 13.1; Annex VII, item 8.2; Annex X, item 20.1 or Annex XI, item 11.1, to restate historical financial information, included in a prospectus and relevant for the financial years prior to financial years starting on or after 1 January 2012, or to a requirement under Annex VII, item 8.2.bis; Annex IX, item 11.1; or Annex X, item 20.1.bis, to provide a narrative description of the differences between International Financial Reporting Standards adopted pursuant to Regulation (EC) No 1606/2002 and the accounting principles in accordance with which such information is drawn up relating to the financial years starting on or after 1 January 2012, provided that the historical financial information is prepared in accordance with the Generally Accepted Accounting Principles of the People's Republic of China, Canada or the Republic of Korea'.

(22) It is appropriate that this Framework Decision applies to the personal data which are processed in the framework of the second generation of the Schengen Information System and the related exchange of supplementary information pursuant to Decision 2006/./JHA on the establishment, operation and use of the second generation Schengen information system and in the context of the Visa Information System pursuant to Council Decision 2006/./JHA of.on access for consultation purposes to the Visa Information System (VIS) by the authorities of Member States responsible for internal security and by Europol for the purposes of the prevention, detection and investigation of terrorist offences and of other serious criminal offences 1 .

L'État membre concerné assure un suivi et prend toutes les mesures nécessaires et appropriées pour veiller à ce que tous les navires pénétrant dans la zone couverte par un système de compte rendu obligatoire des navires, adopté par l'OMI conformément à la règle 11 du chapitre V de la convention SOLAS et exploité par un ou plusieurs États, dont l'un au moins est un État membre, conformément aux directives et critères pertinents mis au point par l'OMI, se conforment à ce système en rendant compte des informations requises, sans préjudice des informations supplémentaires requises par un État membre conformément à la résolution A.851 (20) de l'OMI.
1. The Member State concerned shall monitor and take all necessary and appropriate measures to ensure that all ships entering the area of a mandatory ship reporting system, adopted by the IMO according to Regulation 11 Chapter V of the SOLAS Convention and operated by one or more States, of which at least one is a Member State, in accordance with the relevant guidelines and criteria developed by the IMO, comply with that system in reporting the information required without prejudice to additional information required by a Member State in accordance with IMO Resolution A.851(20).
