To enable Member States and paying agencies to comply with this obligation by following harmonised rules, the Commission should have the power to adopt implementing acts relating to the accounting framework for intervention measures in the form of public storage operations referred to in Commission Regulation (EC) No 884/2006 of 21 June 2006 laying down detailed rules for the application of Council Regulation (EC) No 1290/2005 as regards the financing by the European Agricultural Guarantee Fund (EAGF) of intervention measures in the form of public storage and the accounting of public storage operations by the paying agencies of the Member States , as well as other expenditure financed by the EAGF and the EAFRD referred to in Regulation (EC) No 883/2006.

2. Un État membre qui remplit l’une des conditions énoncées à l’article 77, paragraphe 2, points a), b) et c), peut consacrer une partie des ressources globales réparties conformément aux articles 19 et 20 à un instrument de partage des risques établi au moyen d’un accord de coopération conclu par la Commission, soit avec la BEI, soit avec des organismes de droit public national ou international ou des entités de droit privé investies d’une mission de service public présentant des garanties suffisantes conformément à l’article 54, paragraphe 2, point c), du règlement (CE, Euratom) no 1605/2002, selon des modalités analogues à celles appliquées à la BEI et par la BEI (ci-après dénommés “organisme d’exécution désigné”), aux fins de la constitution de provisions et de dotations en capital en faveur de garanties et de prêts et d’autres facilités de financement octroyés dans le cadre de l’instrument de partage des risques.
2. A Member State that meets one of the conditions set out in points (a), (b) and (c) of Article 77(2), may contribute a part of the overall resources distributed in accordance with Articles 19 and 20 to a risk-sharing instrument which shall be established by means of a cooperation agreement to be concluded by the Commission either with the EIB or with national or international public sector bodies or bodies governed by private law with a public service mission providing adequate guarantees as referred to in Article 54(2)(c) of Regulation (EC, Euratom) No 1605/2002, under similar terms and conditions to those applied to and by the EIB (“contracted implementing body”), to cover the provisioning and capital allocation of guarantees and loans, as well as other financial facilities, granted under the risk-sharing instrument.
