L’article 1er, sous i), de la décision C(2009) 428 final de la Commission, du 28 janvier 2009, relative à une procédure d’application de l’article 81 [CE] et de l’article 53 de l’accord EEE (Affaire COMP/39.406 — Tuyaux marins), est annulé pour autant que la Commission européenne y a constaté que Parker ITR Srl avait pris part à l’infraction pour la période antérieure au 1er janvier 2002.
