First part: The General Court errs in its legal reasoning and disregards the obligation to state reasons, particularly inasmuch as it proceeds on the assumption that, whenever the public authorities impose on specific undertakings a legislative or administrative obligation, the costs pertaining to that obligation must automatically be imposed also on the undertakings in question, without the public authorities being able to intervene in any way and regardless of the purpose of the measure and the link with the exercise of public powers.

Fourth ground of appeal: Finally, the General Court infringed the duty to provide grounds for its decisions, laid down in Article 81 of the Rules of Procedure of the General Court in conjunction with Articles 36 and 53(1) of the Statute of the Court of Justice, since it is not apparent from the grounds for the judgment under appeal that the General Court addressed the appellant’s claims relating to the inadmissibility of flat-rate financial corrections (first part of the second ground of appeal) or the reasons for rejecting those claims are not apparent.

En particulier, s’agissant de la première branche du premier moyen, tirée de la violation de l’obligation de motivation visée à l’article 73, première phrase, du règlement nº 40/94, le Tribunal a jugé, aux points 20 des arrêts attaqués, que la chambre de recours n’avait pas à fournir des références précises à des éléments du dossier lorsqu’elle se référait de manière expresse à l’expérience pratique généralement acquise de la commercialisation de produits de large consommation pour conclure que les marques dont l’enregistrement était demandé étaient dépourvues de caractère distinctif au regard de l’article 7, paragraphe 1, sous b), de ce règlement.
In particular, with regard to the first part of the first plea alleging infringement of the obligation to state reasons referred to in the first sentence of Article 73 of Regulation No 40/94, the Court held, at paragraph 20 of the judgments under appeal, that the Board of Appeal was not required to provide specific references to the documents of the case file when expressly referring to practical experience generally acquired from the marketing of general consumer goods in order to hold that the marks for which registration was sought were devoid of any distinctive character under Article 7(1)(b) of that regulation.

25 S’agissant de la première branche du premier moyen, il résulte d’une jurisprudence constante que le caractère distinctif d’une marque, au sens de l’article 7, paragraphe 1, sous b), du règlement n° 40/94, doit être apprécié, d’une part, par rapport aux produits ou aux services pour lesquels l’enregistrement est demandé et, d’autre part, par rapport à la perception qu’en a le public pertinent, qui est constitué par le consommateur moyen desdits produits ou services, normalement informé et raisonnablement attentif et avisé (voir, notamment, arrêts du 29 avril 2004, Henkel/OHMI, C‑456/01 P et C‑457/01 P, Rec. p. I‑5089, point 35, et du 12 janvier 2006, Deutsche SiSi-Werke/OHMI, C‑173/04 P, non encore publié au Recueil, point 25).
As regards the first part of the first ground of appeal, it is settled case-law that the distinctive character of a trade mark, within the meaning of Article 7(1)(b) of Regulation No 40/94, must be assessed, firstly, by reference to the goods or services in respect of which registration has been applied for and, secondly, by reference to the perception of them by the relevant public, which consists of average consumers of the goods or services in question who are reasonably well informed and reasonably observant and circumspect (see, in particular, Joined Cases C-456/01 P and C-457/01 P Henkel v OHIM [2004] ECR I‑5089, paragraph 35, and Case C-173/04 P Deutsche SiSi-Werke v OHIM [2006] ECR I-0000, paragraph 25).
